This. I don’t think a lot of people realize how broad and how strict the federal contractor mandate is. If your office has workers that work on federal contracts and said workers cannot be segregated from those who do not, the entire office falls under the mandate. The same mandate does not allow the unvaccinated to be regularly tested, and requires fully remote workers on federal contracts to be vaccinated despite their inability to spread the virus to their coworkers. And, it requires masking if the worksite falls in the CDC’s arbitrary definitions of high virus transmission. Seeing that 40+ states don’t have mask mandates, that part alone is bound to piss people off.

The worst part of it is that a lot of companies aren’t standing up for their employees who have nothing to do with federal contracts and fall under this mandate.

Yup, and that was done on purpose. It's a great way to add confusion, defer blame when people complain about the mandate and to strain the private sector by putting businesses between a rock and a hard place. Either you fulfill your contract you signed with the government or you don't. This was also done to get around the whole "nation-wide" mandate because big business, who's in bed with government, has no problem with forcing this on their employees and gives government a pass.

You're crazy if you think this will make a difference. The employers, "have come this far, so we might as well gut it out and keep embracing the mandate to ensure we keep providing a safe workplace."

Their thought process will be that if they've managed to get X percentage vaxxed up to this point, they might as well keep the mandate they've instituted within their companies because now, it's the employer's mandate as everyone up to that point will have been seasoned for it.

What it should do is help people see more clearly how we shouldn't continue to treat employers with the same sovereign rights that one should expect an individual to enjoy.

For example, the excuse that vaccine proponents will use to justify continued enforcement of the employer mandate is that private employers can operate their business however they see fit, and if you don't like what your employer does, you can quit.

That mindset might've worked back in the 80s when employment opportunity was more accessible, credentials weren't difficult to acquire (or as costly), we didn't have as many people on Earth, things weren't as automated, or the dollar had more oomph... Equitable opportunity is a thing, so continuing forward with this idea that if you don't like the vaccine mandate, you can just waive your balls at it and go work somewhere else, just isn't realistic. Some might be able to pull that off, but I'd venture to guess that 90% won't and for completely justifiable reasons.

But with all this being said, I'm not sure what the solution is unless we can somehow find a way to balance government intervention with private independence. All I know is that what we have now isn't working but that it's only going to get worse, especially once a Miles Driven tax is strong-armed into our lives.

There's still a problem in that the court thinks any business with a "good enough reason" can still force vaccinations. This statement isn't the win some people think it is. NO business has the right or privilege of requiring medical treatment or testing of its employees.

This ruling then is still supporting the basic idea that if a business sees a need, then they can still mandate even without OSHA ordering it. Waitresses come face to face with a lot of people in a short time. Boom. Waitresses are now required to be vaccinated because the business felt it has a "good enough reason."

ALL compulsory medical treatment and testing should be reinforced as illegal. None of it was legal before, but our courts have been flawed for a very long time. The door that allowed this all to happen, mandatory vaccinations for things like MMR, are how we got here. Those mandates never should have been allowed to stand.

Indeed, the Mandate’s strained prescriptions combine to make it the rare government pronouncement that is both overinclusive (applying to employers and employees in virtually all industries and workplaces in America, with little attempt to account for the obvious differences between the risks facing, say, a security guard on a lonely night shift, and a meatpacker working shoulder to shoulder in a cramped warehouse) and underinclusive (purporting to save employees with 99 or more coworkers from a “grave danger” in the workplace, while making no attempt to shield employees with 98 or fewer coworkers from the very same threat). The Mandate’s stated impetus—a purported “emergency” that the entire globe has now endured for nearly two years, and which OSHA itself spent nearly two months responding to is unavailing as well.

And its promulgation grossly exceeds OSHA’s statutory authority.

Mandate is a one-size fits-all sledgehammer that makes hardly any attempt to account for differences in workplaces (and workers) that have more than a little bearing on workers’ varying degrees of susceptibility to the supposedly “grave danger” the Mandate purports to address.

Mandate makes no serious attempt to explain why OSHA and the President himself were against vaccine mandates before they were for one here.

Because it is generally “arbitrary or capricious” to “depart from a prior policy sub silentio,” agencies must typically provide a “detailed explanation” for contradicting a prior policy, particularly when the “prior policy has engendered serious reliance interests.” OSHA’s reversal here strains credulity, as does its pretextual basis. Such shortcomings are all hallmarks of unlawful agency actions.

We next consider the necessity of the Mandate. The Mandate is staggeringly overbroad. Applying to 2 out of 3 private-sector employees in America, in workplaces as diverse as the country itself, the Mandate fails to consider what is perhaps the most salient fact of all: the ongoing threat of COVID-19 is more dangerous to some employees than to other employees. All else equal, a 28 year-old trucker spending the bulk of his workday in the solitude of his cab is simply less vulnerable to COVID-19 than a 62 year-old prison janitor. Likewise, a naturally immune unvaccinated worker is presumably at less risk than an unvaccinated worker who has never had the virus. The list goes on, but one constant remains—the Mandate fails almost completely to address, or even respond to, much of this reality and common sense.

At the same time, the Mandate is also underinclusive. The most vulnerable worker in America draws no protection from the Mandate if his company employs 99 workers or fewer. The reason why? Because, as even OSHA admits, companies of 100 or more employers will be better able to administer the Mandate. That may be true. But this kind of thinking belies the premise that any of this is truly an emergency. Indeed, under inclusiveness of this sort is often regarded as a telltale sign that the government’s interest in enacting a liberty-restraining pronouncement is not in fact “compelling.” The underinclusive nature of the Mandate implies that the Mandate’s true purpose is not to enhance workplace safety, but instead to ramp up vaccine uptake by any means necessary.

It lastly bears noting that the Mandate raises serious constitutional concerns that either make it more likely that the petitioners will succeed on the merits, ... First, the Mandate likely exceeds the federal government’s authority under the Commerce Clause because it regulates noneconomic inactivity that falls squarely within the States’ police power. A person’s choice to remain unvaccinated and forgo regular testing is noneconomic inactivity.

Second, concerns over separation of powers principles cast doubt over the Mandate’s assertion of virtually unlimited power to control individual conduct under the guise of a workplace regulation. As Judge Duncan points out, the major questions doctrine confirms that the Mandate exceeds the bounds of OSHA’s statutory authority.

The public interest is also served by maintaining our constitutional structure and maintaining the liberty of individuals to make intensely personal decisions according to their own convictions—even, or perhaps particularly, when those decisions frustrate government officials

But health agencies do not make housing policy, and occupational safety administrations do not make health policy. In seeking to do so here, OSHA runs afoul of the statute from which it draws its power and, likely, violates the constitutional structure that safeguards our collective liberty.

Huh, this is real weird.
