They have been over sources on Rekeita a bit. There was so much footage dumped from that night I am certain I saw the first shot on video somewhere.

The problem they have with taking blind footage is it may be doctored. So, they have taken sources from who they can validate and bring on the stand. This way the footage is tied to the credibility of the individual who recorded it. Otherwise the footage gets a big red asterisk next to it.

As far as the defense attorneys. Barnes indicated Richards won’t listen to the noise that is the public. He even offered to get a website together or rather had volunteers.

Kyles attorneys have some holes. Hopefully the prosecution screwed up enough to make this a mistrial.

Even if they get a conviction it won't survive an appeal. This is why I think the jury will find him guilty of one charge probably the kid rapist who grabbed his gun and got hosed so they can keep the mob from fucking with them. A US marshal has already confirmed two of the jurors have been threatened and are considering a guilty plea to appease the mob.

I would caution reading too much into the US Marshal claim, this isn't a federal court and although there may be some US Marshals there offering security due to the fact it's a high profile case, it would only be a few... I'm hesitant to believe they would be privy to what is happening in the jury's private deliberation room and would leak a rumor like that, a leak that would almost certainly cause them to be identified and lose their job or worse face criminal charges...

Its not really about the content of the footage.

Its about the fact that the prosecution is required to turn over all the evidence to the defense, prior to the trial. Especially in the case that the prosecution intended to use said evidence as part of their case.

The fact that they only turned over a far lower resolution copy of that footage goes to illustrate how the prosecution is doing everything it can to deny the defendant his right to a free trial.

they put an easy win on the scoreboard for the prosecutor

the only thing it does for the defendant is to eliminate possibly being convicted by a jury

the prosecutor usually over charges so the defendant gets what he would have anyway

I agree, but I'm starting to be disturbed by how many are propagandized and those that aren't. Those that aren't deserve to be held accountable legally.

I'm just thinking back to post-WW2 and the Nazis that the Allied Powers let go citing brainwashing. A girl who was "150% Nazi" by age 15 in 1933 was lot go in around 1946 or 47 - she was deemed to have essentially been brainwashed since childhood.

If we put that in modern time frame, a 15 year old 13-14 years ago would be 27ish now. How many of the morons being promoted by the news are the equivalent of brainwashed during childhood? I can tell you for a fact the CRT stuff has been in schools and childhood programming for at least 20 years and only in the last 5 or so has it gone completely insane.

Even if this ended tomorrow - the fallout is going to last decades. It's just too much on a scale that's almost impossible to imagine.

Judges aren't supposed to be juries. Judges make sure the proceedings are fair so juries can make their decision without unfair bias.

Any party who decides to acquit in this case is at serious risk of harm. If the judge acquits everybody knows who he is and if the jury acquits they will be doxxed.

The prosecuting attorney has been playing tricks, trying to get the judge to acquit, by breaking the rules of procedure. By doing this the left can scream that Kyle was acquitted not by a jury, but by a biased judge.

The judge doesn't want to acquit, because it's not his job to render a verdict and because whoever acquits is in serious risk of harm. So the best thing for the judge is for the jury to acquit. It takes the risk for harm off of him and puts it onto the jury.

If the judge were to dismiss before jury came back, it would be a total waste to submit this now of all times. However, if the judge rules moot after jury acquits on something that was this severe, that’s also injustice. The prosecution should be punished either way the jury rules.

He should toss it out now. if a lower res video was provided it's because the prosecution saw that it was not as revealing as the full res video, and if it appears to paint the events in a different light then they knew it would give jury members the wrong impression and it was done intentionally.

Don't even let the jury decide because the prosecutor's presentation of evidence was incomplete or distorted.

Lol dopey reply and wrong. Did you even read the motion? State tampered with evidence, withheld true HD footage and sent defense team 480p film to base arguments on. Kyle saw nothing when shown that video. Then the state tried to share “our version is clearer” when pointing to the Jury, the same point in the footage. The state didn’t simply withhold evidence, they gave intentionally bad evidence to the defense, to sink them. That’s prosecutorial misconduct and the judge can always take the case away.

Where did you source this from? I work in video professionally and can tell you with 100% certainty that the state's original source file as seen here is nowhere near the quality recorded on that drone. Even a consumer-level drone would capture this video at a higher bitrate than what is presented here. The compression artifacts completely muddy the details completely. The camera original files would certainly exhibit sharp noise from the low-light night scene which can't be seen here.

Where are those camera originals? Is this the FBI's angle or was it from a random individual?

It's an optics game. A jury acquittal is much better for optics than the judge ruling a mistrial. The DA knows this, which is why they're INTENTIONALLY trying to break procedure in order to make the judge declare a mistrial, instead of having the jury reach a verdict. Even a hung jury with dismissal looks better optically than the judge dismissing the case for procedural issues.

Mistrial with prejudice is the same as an acquittal I believe as far as consequences for Kyle go. Maybe even better if he decides to turn around and sue Binger (I don’t know).

I think the judge will accept the motion for mistrial with prejudice. First of all, he knows it's the right call. Secondly, the judge doesn't want a hung jury/retrial because jurors are scared. By throwing the case out via the mistrial with prejudice, he lets the jurors off the hook with the fag mob.

The proper comment from this user should have been "Does the timing of the motion matter in the trial? What if the jury decides today, can the judgement still be dismissed with prejudice?" The entire Justice System and Legal Profession needs a Flaming overhaul... When Laws are so convoluted that it takes a 'Special Class' to understand them [and STILL argue the meaning], than those laws are by their very nature; Impossible to understand by those that are meant to live by them, and Impossible to police as a full understanding and clarity cannot be held by those tasked to do so.

This is not by accident... It is meant to confuse, so that a multi-tier system can operate in full view, without being looked at to hard.
