Barnes and the guy who literally wrote the book on the law of self-defense, Andrew Branca think the most likely compromised verdict will be second degree reckless endangerment which carries a TEN year sentence plus FIVE extra for committing it with a gun. As much as I agree with you, I could say "devil's advocate" is that if she really is following the instructions of the court, then she would know she is not supposed to google the instructions, and could only legally possess a copy of the instructions if they are given to her by the court.

So on the face of it, that's technically the correct way to go about it. But it really seems like the discussion has boiled down to splitting hairs and her trying to find some definitions of legal terminology in hopes of getting her way.

Nah, they will be done before Thanksgiving. Wednesday at the very latest, but more likely Monday. A mistrial is the best outcome now, but I suspect a compromised verdict of guilty on reckless endangerment which will get Kyle up to 15 years in prison.

The judge is being smart, letting the Jury make the decision on as much as possible, get as much right as possible, before he steps in and makes a ruling on the defense's motions for mistrial, with or without prejudice.

The lawyer you're thinking of is Robert Barnes, along with some of his lawyer pals. They were let go from the defense team shortly before jury selection. Barnes is an advocate for the theory that most of a case is decided at jury selection, and that lawyers should heavily research jurors using social media.

When I was a juror we weren’t allowed to even take our own notes home. What? This is insanity. In NJ and I thought most/all other states there is no way a juror would be allowed to take home the jury instructions. Repeated ad nauseam in the jury charge is how they are not to do any research on their own, no looking up stuff in dictionaries or anything. No outside influences. They can only use what they heard/saw in the courtroom. And deliberations are only to happen IN the jury room. They cannot discuss anything with anyone outside of the jury room.

It doesn't matter what the juror is using them for. This is not allowed in most places. Jurors are not supposed to do their own investigations on anything -- not even looking up legal terms. Jurors are supposed to all have the same information -- what is presented to them in the courtroom. One juror doing "homework" at night and coming back the next day with their results is not supposed to happen. Our courts in NJ drill this into jurors over and over again to stress how important it is.

I know in my state, they're books. Printed law books and available to the public. They cover every crime and help the jury decipher elements of a crime. A good police detective will refer to them before submitting a case to the DA for prosecution or seeking an arrest warrant.

If he gets convicted, then the Judge will adjudicate the Defense's requests for Mistrial (both with prejudice and without prejudice). Should the case be declared a mistrial with prejudice, then Kyle is free and they can't re-try him. If it's a mistrial without prejudice, he gets a new trial. If the judge doesn't declare a mistrial, then Kyle can start filing for appeals.
