No. The request from the Plaintiffs was a nationwide ban or (at minimum) immediate relief for the 10 Plaintiff states.

The judge destroyed the government mandate thoroughly, but only issued the stay for those states. But, I think the involved states have implications for other circuits that have active cases pending.

Yeah, this ruling and the ruling in the Ascension Hospital case in Florida (don't have the case # rn) have the judges making assessments about the vaccines themselves and none of their assessments are good. And, their rulings are now on record and are not disputed by the Defendants.

Also, the evidence shows that vaccinated can get and spread COVID the same way unvaccinated, so how is this an "emergency".

I know our TX AG (Paxton) has an active federal suit going for the CMS mandate and it probably includes several states but I'm not certain with that. The good thing about this is that Paxton is the best AG in the country and gets shit done quickly. His cases get heard in the 5th Circuit of Appeals which is our most based court. Once they get a ruling at the appeals level, it applies to all the states.

This has never been about private employers hopping on the bandwagon of forcing their employees to take poison for no fucking reason.

Businesses started enforcing mandates when the OSHA announcement came out, or the rules from CMS came out for healthcare.

The vaccine does not prevent you from catching or spreading covid, so there is no scientific reason for forcing anyone to take it - and if the vaccine even did what the branch covidians claim it does (reduce symptoms) then it will actually make the vaxxed MORE likely to spread covid. There’s no evidence it actually reduces symptoms, but that’s beside the point.

So with no actual benefit, and unknown (at best, likely heart and immune system issues of varied severity) long term negative effects, there is no free market reason for any business to force their employees to take it, especially when they are already understaffed. This is being entirely driven by government intrusion into private business. This has absolutely nothing to do with protected class rubbish.

People get laid-off all the time. Employers go out of business.

When my employer inquired about my vaxx status I mustered up a group at work, we hired a lawyer, and replied with a letter from the lawyer saying basically, "fuck you, talk to my lawyer". I'm not necessarily in the greatest financial position to pay the lawyer but it's worth it IMO. Punch these motherfuckers in the mouth when they step too far.

I was hoping our politicians in Indiana would do something about this today, but alas they do not care enough for us peasants to do what they are paid to do. I have not heard a peep from our governor either. Been looking at a move to Florida so I don’t have to deal with this stuff anymore.

Yeah I’ve emailed and called. I was disappointed they canceled the session that was supposed to occur today. My company says Dec 5 you must have your first in order to be “fully vaccinated” by Jan 4.

I applied for religious exemption which was denied. I appealed

I won’t get it

I will have to, worst case, reconsider in a few months of this doesn’t get overturned here. I can get by for a few months. Eventually I’ll go mad if I can’t work in my chosen profession

I second what Jujubees said. I've communicated with two lawyers and have heard mixed things. One said that a company should be afraid to deny you because of potential lawsuits, but you should be as vague as possible in your request. They also said the more info you give, the more ammo you are providing that can be used against you. The other said that you should be as specific as possible, give Bible quotes, and focus on how the contents of the shots violate your deeply held religious beliefs. They also said you should not argue that you are afraid of bodily harm from the shots, because it's quite clear companies do not care.

What kind of things did you say in your exemption request?

My plan is to file the religious request. If I get it, great. If not, I still will not comply and intend on making my company fire me.

Will your employer offer specific guidance on which shot to take? Has anyone asked?

Remember, in most cases, employers are leaving the ball in the employee’s court. This is by design, to reduce confrontation and “incidents” during mass layoffs.

-if you get the shot, it was your choice.

-if you “refuse” the shot, or ask for an exemption, then you implicitly admit to breaking the rules, and your employer is justified in firing you.

But if you ask for clarification of the rule, that’s where your employer will become extremely uncomfortable. You will still be fired, but you can make it clear that the firing is without merit.

Ask exactly which shot you are required to take and do not accept a non-answer. Provide your employer with the literature from the pharma companies, explicitly stating that the vaccine “may not be right for everyone.” Since it is their mandate, ask them to warrant, in writing, that they are providing medical advice that the vaccine is right for you, and assuming liability for that medical advice over the lifetime of all their employees. This will need to be notarized by an appropriate owner/officer of the business.

Of course your employer will not be willing to do that, and they will still fire you.

But if anyone bothers to press the issue, it will become clear that they are not mandating a vaccine. They are mandating an obedience test.

What they are doing is illegal, this is still a medical experiment, and that is why we have the Nuremberg Code. Nobody can force you, just say no, let them fire you, and then file a lawsuit. It's the same end around this post is describing. The feds are threatening any med establishment that treats medicare/medicaid patients with non payment. Naturally these business (nursing homes, hospitals, therapy and rehab centers) aren't pushing back as the government is their number one source of money - it's total bullshit. I have advised them to get a lawyer and get the state involved as Montana seems to have some backbone in such matters. Totally agree. The jab is an ineffective, dangerous experiment.

Oddly enough, the Florida lawsuit was filed the day before DeSantis signed the new state laws, which would supercede the OSHA or CMS-driven jibberish. The lawsuit made reference to the new laws, but the laws were not in place when the suit was filed.

I don't know why Florida AG didn't write an amicus to the existing case. And, not sure why the Florida AG didn't wait to file the suit and have the power of Florida law to strengthen their case.

I posted the CMS result to the site about 5 minutes after it was posted (https://patriots.win/p/140c067UCn/cms-stay-granted-but-only-in-the/) and have been hoping for a lawyer Pede to makes some heads and tails about how this was going to play out.

Great. Now we need one against NY, Erie County and the Buffalo and Erie County Public Library. ALL are trying to implement their own Mandates.

The Library system here is basically doing it to "Purge" all the holdout conservatives in their ranks, as the system is headed by lefty kooks but many of the librarians are conservative.
