Gorsuch has made some solid Constitutional rulings, but he hasn't been subjected to the same kind of unhinged hoaxes that Kavanaugh or Barret were subjected to.

91
shaven_llama 91 points ago +93 / -2

Gorsuch is a hard core libertarian. Which leads to some bizarre rulings on social issues. But on a 2A issue like this, I’ll bet he’ll vote correctly. Kavanaugh and ACB on the other hand…

69
MasksAreChildAbuse 69 points ago +69 / -0

Thomas: Uh yeah the constitution says right here “shall not be infringed...” guess it’s an open and shut case...

ACB: BUT MUH IMPORTED MINORITY BAAAAYYYYBEEEEES!!!!

Rest of Judges: well that settles it, ACB made a bulletproof point.

Honestly, on almost everything, Thomas has the most common sense takes on the law. For example, all our implied rights get brought in under “liberty” but it would make more sense for them to come in under “privileges and immunities” except the Court fucked that up in the 1890s in the Slaughterhouse cases. No one else will touch it but he keeps coming back to that well and mentioning how dumb it is.

1
Foreign_Aid_is_Theft 1 point ago +1 / -0

Which is interesting because Kagan was talking about that today saying that they hadn't determined if that was specifically for militias or the citizens in general (which is stupid, it's the bill of rights). Nowhere do I see any infringement laws saying "except for militias" in which case couldn't we just have a militia challenge the law that would mean we could own tanks and nukes as long as we belong to a militia?

1
RStroud 1 point ago +1 / -0

That's an idea. Perhaps we should have states formally recognize that all resident citizens are a member of their state militia. Even better, they could supply such arms necessary for the defense of the state, to their members for a modest fee.

The 9th U.S. Circuit Court of Appeals overturned a ruling by two of its judges and upheld California’s ban on high-capacity magazines Tuesday in a split decision that may be headed for the U.S. Supreme Court.

9th Circus strikes again.

“The statute outlaws no weapon, but only limits the size of the magazine that may be used with firearms,” the court said in the 7-4 ruling.

Outlaws no weapon? Try buy a normal AR15 in CA or an SBR anywhere in the US.

The majority reasoned that “the record demonstrates that the limitation interferes only minimally with the core right of self-defense, as there is no evidence that anyone ever has been unable to defend his or her home and family due to the lack of a large-capacity magazine; and that the limitation saves lives.”

See, its okay because we only minimally infringe on your rights by banning standard capacity magazines.

65
HuggableBear 65 points ago +65 / -0

the limitation saves lives

I don't recall the clause in the second amendment that says it becomes invalid if infringing on it saves lives

6
deplorablepepe4 6 points ago +6 / -0

dependent upon the situation....The limitation can prevent you from saving your own life.

1
Sek7or 1 point ago +1 / -0

Shall not be infringed.

46
Chosen_1_1162 46 points ago +46 / -0

A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms may only be minimally infringed

  • 9th circus reading of the 2nd Amendment
1

31
deleted 31 points ago +31 / -0
15
current_horror 15 points ago +15 / -0

There are a lot of things happening here, but the two that stick out to me:

  1. As you said, they are misrepresenting the argument. The higher purpose of the second amendment is to deny the government a monopoly on force. This encompasses self-defense, but that does not give a court permission to make rulings against the higher purpose using the lesser purpose as cover.

  2. In practice, this is a ruling in favor of leftist mob justice. Your right to self-defense ends when the group attacking you achieves a certain size. Gee, I wonder why people who circumvent law and order via mob rule would move to limit your ability to defend yourself against mobs...

5
BigDickTurner 5 points ago +6 / -1

...the limitation interferes only minimally with the core right...

So, it does interfere with a core right.

Game over; case fucking closed. The right is infringed, the law is null and void.

This is like saying "we didnt ban swords, only long sharp blades, so you can have a blunt sword or a 2" blade". Its fucking ridiculous anyone takes this shit seriously.

We already lost it, the head of elections in Tarrant county is an illegal Venezuelan immigrant who's also a communist. He brought in Dominion voting machines and that's why Tarrant county went blue last election, rigged.

1
rupok2 1 point ago +1 / -0

source for this? The voting system I used recently was not dominion in Tarrant county. Its a digital machine but there seems to be alot of checks. You give an id to the election official who gives you a unique code and a paper for the machine. You enter the code into the machine and then place the paper inside as well. You then vote on the digital machine, it prints that vote into the paper. You double check after you are done on the paper. It then goes into a final machine which digitally receives the vote and keeps the paper inside.

Sure, if they call what used to be a medium size drink and now call that a regular or large size, now they can call what used to be the normal or regular size a 'Jumbo' or 'Extra Capacity' or 'Extra Large' size.

I think there was one dude who got charged and had his charges dropped after he got a lawyer. But thanks to the federal judge Roger Benitez. He basically legalized all the "high capacity" magazines in Californians possession. All the magazines purchased before and during the "freedom week" are not illegal. So you basically have to be caught importing them to be charged. Or selling or transferring one. I have like a hundred or more of them myself and Ive never worried about going to a range. Route 66 range doesn't care. I don't really go anywhere else to shoot other than out in the desert where no one will find you and the few wildlife rangers and stuff are way to scared of running into some narcos or something out shooting their guns. Hours away from people on a desert trail. They don't even dare. Unless they want to end up buried out there. I hear what sounds like automatic bursts and people who dump 30 or even more rounds without stopping. No time for a mag change. Idk if they have FRT triggers or can bumpfire as fast as miculek. But the more crowded shooting areas like the one near Victorville off the 15. You can go out there and see people shooting everything and hear it from the highway.

I am sure the gun tubers and stuff you see online that are from California follow those rules on camera because they know how the DOJ works and that's probably who they actually would bring charges against. But I know a guy who was arrested multiple times and was carrying a "ghost gun" in California with more than 10 rounds. He kept telling me he was certain he was going to jail. I thought he was too. Nope. D.A. doesn't have the time or care enough to recommend he serve time in jail. Idk because of covid or he likes criminals. But it's really hard to get locked up in California. Unless you're a known MAGA supporter, then you will have the book thrown at you.

Crucial8GB 5 points ago +5 / -0

I'll tell you a little secret. Banning high-capacity magazines is pointless because FFL's are allowed to give you your magazines disasembled. They will literally take them apart and hand them to you.

4
p1smo [S] 4 points ago +4 / -0

Most handgun magazines sold in California are specifically manufactured to only accept 10 rounds, and rifle magazines are usually pinned/epoxied, although that isn't really a "permanent" option.

Either way it's already pointless because literally millions of standard cap magazines were sold during "freedom week" when the initial ruling was overturned before an injunction was filed. That genie is already out of the bottle.

If they don't file another injunction or overturn, this will effectively be a retroactive ban with no compensation. Absolutely unconstitutional, as if the ban itself wasn't unconstitutional already, but to paraphrase a Californian politician:

Our job isn't to worry whether the bill is constitutional, our job is to pass it.

Can't say I'm surprised. It is the Nutty 9th we're talking about.

All gun laws are unconstitutional

2
mikethemarine 2 points ago +2 / -0

Yup, I say if you want a TANK and can afford it, GO RIGHT AHEAD AND BUY IT, if you want and F-16 totally armed all the power to you, the infrastructure for these items are a bitch, but I say if you want it, you should be allowed to have it,

From the article:

The majority reasoned that “the record demonstrates that the limitation interferes only minimally with the core right of self-defense, as there is no evidence that anyone ever has been unable to defend his or her home and family due to the lack of a large-capacity magazine; and that the limitation saves lives.”>

  1. There is absolutely zero evidence that lives have been saved
  2. Limitation=infringement
  3. FJB
4
p1smo [S] 4 points ago +4 / -0

Yeah it's completely circular logic. They have no evidence magazine limitations save lives, while demanding evidence that magazines with no limitations saves lives.

They seem to believe the Constitution is a piece of toilet paper to flippantly wipe their swampy asses with. Instead of treading carefully, they run roughshod over it.

Deathmelody 4 points ago +4 / -0

It’s ok guys. When we have to take over California. They will only have 10 bullets while we have 30+

4
KekistanPM 4 points ago +4 / -0

Should have headlined it "Court upholds end run around 2A"

3
trad_patriot 3 points ago +3 / -0

Commiefornia is a lost cause. If you value and support freedom, you have to leave, but if you support commiefornia libtarded laws and policies, STAY - we don't need that shit spreading to other parts of the country.

Ha! Take that, criminals! Now you cant use standard or high capacity magazines to carry out your crimes! Way to go, team! We did IT!

9th Circus. Not surprising.

3
Sarthax 3 points ago +3 / -0

The 9th is literally 50-0 in favor of the state when it comes to 2A cases. They have only ever ruled in favor of 1 2a case and it really was a 1A case about advertising.

Another reason to leave California for dead... (as if we need another reason)

bwjenkins1 3 points ago +3 / -0

Screw California

3
ChuckedIntoAVan 3 points ago +3 / -0

A minimal burden is still an infringement. The Supremes are just as corrupt as the rest of the government though, so who knows what will happen.

So... since we can ban guns, let's just ban bullets or things that hold bullets.

Like come on! None of this shit makes any sense. Right to keep and bear arms was based on a principle that you should be allowed as a citizen to have the ability to keep deadly force to protect yourself. It doesn't matter if it is a gun, a knife, or a shovel, you need access to deadly force, because others will elsewise use such deadly force against you.

"only minimally interferes with 2nd amendment"

What in the FUCK!

SHALL NOT BE INFRINGED COCK SUCKERS

2
NonyaDB 2 points ago +2 / -0

Remember that the 9th Circus is the most overturned appeals court in U.S. history, constantly being slapped by SCOTUS.
If this goes up to SCOTUS it will get smacked down.

2
p1smo [S] 2 points ago +2 / -0

Pardon my condescension, but you sweet summer child. SCOTUS has punted every legitimate 2A case that's come across their desk since Heller, and they'll likely do the same here too. Roberts would rather sit back and let the country balkanize itself into tribal territories of totally conflicting precedents than sack up and deliver a ruling that's controversial. I could be wrong, and I certainly hope I am, but modern history isn't really on SCOTUS' side in this regard.

<looks behind him at the hundreds of 'standard capacity' magazines on his shelves>

<Sandmann smirk>

2
p1smo [S] 2 points ago +2 / -0

You and every other pro-2A Californian. Literally millions of standard cap mags were sold during freedom week, like that was stopping anyone before or now anyway.

Point being, that genie ain't going back in the bottle.

2
MrStep 2 points ago +2 / -0

It's insane. The 2nd Amendment specifically discusses militias and the right of citizens keeping and bearing arms not being infringed because of the importance of that. Nowhere did it say "no military-grade weapons or high-capacity magazines because you don't need those to defend your home". Home defense? Did I miss that part of the 2A?

Not to mention... if that's the argument, then it depends on what you have to protect your home from, because a tyrannical government would certainly justify needing military-grade weapons.

But that's a moot point, there's *nothing allowing bureaucrats, politicians, or judges to even try to illegally regulate it to begin with.

2
capnpyro 2 points ago +2 / -0

Stop saying high capacity, they’re regular capacity

2
p1smo [S] 2 points ago +2 / -0

I know, not my words. Simply quoting the article headline.

capnpyro 1 point ago +1 / -0

Gotcha!

1
mikethemarine 1 point ago +1 / -0

In Cali. (1) round is too high of a capacity

2
MAGA_MEME 2 points ago +2 / -0

I'd say that if you are in CA you should look at belt fed options

1
p1smo [S] 1 point ago +1 / -0

The commies thought of that too. Linked ammo can only be in 10 round increments.

1
Sarthax 1 point ago +1 / -0

I could be wrong, but even possessing links that can be reassembled is illegal. They have to be destructive links or some shit.

1
p1smo [S] 1 point ago +1 / -0

Not saying that isn't true, I've just never heard that, only that post ban links have to be assembled in increments of 10. But that was before freedom week too, so I'm sure there's guys now with entire stockpiles of fully loaded box mags.

Guess we have to wait and see if an injunction is filed to protect grandfathered owners, or if they're gonna go full commie and try to ban ex post facto.

2
ArcanumAbsurdum 2 points ago +2 / -0

Yeah, I inherited a bunch of circa 1970s-80's and 90s Playboys from my grandfather and the early ones got to be 400 pages so, I can state with relative certainty this has been going on for quite awhile....oh, wait.

2
Secretyrussianspy 2 points ago +2 / -0

I just buy clips and magazines out of state. There is no need to comply with Unconstitutional laws. Just don't be an idiot and put yourself in a position to get caught, and you won't.

2

The second amendment was written to help the citizens protect itself from a tyrannical government. The magazines should be at least equal!
