Right before my brother quit his job and found another one he had a meeting with his manager where the manager cited CDC guidelines for their policy of employees having to continue wearing masks if they did not furnish proof of vaccination. .my brother said that he informed the manager that CDC guidelines were not law and when the manager was confronted with that fact became angry and actually lunged at him from across his desk.

He said he knew at that point he was making the right decision.

To add onto these states what would be smart is passing a law allowing employees to be "fired" and rehired as contractors under their own business, as long as it's explicitly to avoid the vax mandate federally.

If they try shit again the feds will try to lay on fines and dip their evil fingers into the business' bank accounts BUT currently the rule doesn't include contractors, but most states ban contractors who act as employees but this could be a good workaround as a middle finger to the feds

The HHS thing involves a different agency, with different rules, for different reasons, and only affects medical companies/facilities that accept Medicare/Medicaid.

The moment a hospital refuses to take any Medicare/Medicaid patients (or any federal funding), the mandates stop for them and their employees (barring any state actions, such as Oregon's stupid healthcare vax mandate). That's the tradeoff.

OSHA on the other hand didn't have the authority for this in the first place, and Brandon was trying to wedge in that authority.

What OSHA will do is coordinate with the IRS & FBI to have any "violators" company bank accounts frozen, then just deduct the fine right out of the account.
And then they'll pressure the bank to stop doing business with the "violating company".
And then the FBI will launch an investigation/fishing expedition looking for the least little thing to indict the company owners on.

This is the time to fight the General Duty clause. OSHA has always used this as their "gotcha" clause for anything not legally enumerated, because in their view, employers have a never ending duty to eliminate "hazards" in the workplace no matter what. Employers are cited for it all the time, and for most employers it is easier to just pay the fine and move on rather than fight it. In its simplest form it is piracy, but more realistically it can be used nefariously to circumvent our system of law in cases such as this. OSHA is almost BATFE or IRS bad. It has been weaponized.
