The court agreed that Budowich's request for an emergency injunction was “moot” given that the bank already supplied the documents, but agreed to rule on the merits of the arguments about whether the subpoena was legal.

The parties’ briefs on this question were submitted to an Obama-appointed federal judge, James Boasberg, in Washington. The oral argument on Budowich's request to enjoin the use of his banking records by the committee was held earlier on Thursday, and Judge Boasberg quickly rejected Budowich's objections to the subpoena. It will now be appealed to the Court of Appeals, but the issues presented by the committee's argument are chilling.

James Boasberg was the presiding judge on the FISA Court until May 2021. He was succeeded by Rudolph Contreras, the "Rudy" who is BFFs with Peter Strzok and was featured in the infamous Strzok-Page text messages.

What a gross abuse of power. Concress' powers to investigate are generally limited to failures, criminal activities and potential high crimes and misdemeanors committed by government and quasi-governmental officials, not private citizens. The infestigation of private citizens falls to policing and law enforcement agencies. This step by Congress is in essence the trampling of the constitutional right of administrative powers. Furthermore, the use of Congress as a legal bully pulpit against the private citizenry's right to protest is clearly seen as a threat to the citizen's right to contest government overreach. These are gross constitutional violations. The most obvious breach of the people rights are those being held without charges, on what would be considered minor infractions (if any) and simple vandalism or petty theft at worst, and yet incarcerated for as much as a year without normal due process, writ of Habeas Corpus and in complete violation of the 8th Amendment. Liz Chaney and her colleagues at this point are in violation of their oaths of office and more concerned about the plight of politicians that could lose their power, than the people from whom they believe it their authority to remove their GOD GRATED civil rights.
