Many believe the 5th amendment is only for the guilty. They are wrong. Even if you aren’t guilty, you could easily be put in jail by our “justice” system which can and will use everything you say against you. No reason to give them more evidence. That’s why it’s best to invoke your 5th amendment right to not incriminate yourself and to remain silent.

there's actually a book out there and I forget what it's called but it lists hundreds of cases of innocent people that were sent to jail because their words were twisted in a court of law. the books mean theme is that your right to remain silent should always be taken and you should never speak to the cops without a lawyer present..

This sort of thing has always bothered me. I’m not a cop hater or anything, but even as a law-abiding citizen I never feel comfortable around them. They are supposed to be there for my safety as a citizen, but I always get the feeling that they’re poking around for something. Just the idea that police at any level of government have authority over you and are often eager to dig for something, anything to get you on even though there is no apparent wrongdoing is unsettling to me. I don’t like that the law can be taken advantage of, that it is considered wise to NOT talk to the cops, who we are supposed to trust.

It's not just about putting together a defense, the whole premise is you're innocent until proven guilty.

Even if you are guilty, under the law, you are still presumed innocent until your accuser proves you are guilty. After all, they are the ones with the burden of proof, and not you. This is also why you never plead guilty or no contest either, because there could be a chance you can't be proven guilty beyond a reasonable doubt.

That's what your lawyer and other witnesses not implicated in the charges are for. The burden is on the prosecution to prove their case, defendants are often cautioned against testifying by their attorneys, outside of some limited circumstances, and many of them have nothing to do with guilt.
