I there were anything truly sensitive, they would have slapped the cuffs on day one. You don't wait for a grand jury to indict if you have probable cause for an arrest. I think threatening to sell nuclear secrets would fall in that bucket.

And this gets back to the fact that even if there were classified documents, the government would have to prove that Trump didn't declassify them prior to leaving office. He's the president. If he walked up to the documents, waived his hands (or didn't waive his hands) and said "declassified", then they are declassified. Impossible to prove he never did this.

This is why, in a non clown world, you would never go after a former president for this kind of thing. It's beyond absurd.

This capability is widespread at the law firms in DC, and should also be within DOJ. So what did they see? It was one of two things: either the files were exactly as they'd left them the last time, any differences reflected well on the President, or the planted "evidence" was missing.

As it stands, the federal bureaucracy is the biggest check on all branches and the states with barely any check on it. That's as extra-constitutional as it gets. It's not even supposed to exist, much less have this level of autonomous power.

Only way out is an entire elected government with the will to reform it by hook or by crook with the fortitude to take the beating that will come with that, or a Convention of States.

Back when I was in the Arny I worked on a nuclear capable M110 howitzer, they placed me in that unit as I have a high IQ. The test score used to be called the GCT. Now the ASVAB. You took a preliminary test during the induction, to see if you could find the door in three tries, and you could top out at 100. You had a more comprehensive IQ test in boot camp. Certain of us were called out a week or so later for followup tests on our knowledge and suitability for some MOS specialty. Results only came after you graduated. Since, in the Corps, you didn't get an MOS choice, I only knew where I was going when the Senior DI, the evening we graduated, read off our next duty station. Because nuclear is a trigger word for many people, including some (too many!) around here. Because we crave excitement and adventure and tabloid thrills, if given insufficient detail "Because son, it's Atomic. And Secret." they will tend to overreact rather than under react. Video games are partly to blame for this because they plant the idea that there are Magical Items in the world, whose mere possession makes you a Mage. Are there really any Mage nuclear secrets today? Or has nuclear become just a smear-word the immoral can use to panic the sheep?

Since we're doing video games, let's assign 0-10 Magic levels.

  • Level 10: information that describes the next generation device. In 1953 we fried Julius and Ethel Rosenberg for passing information to the Soviets during and after WWII, which may well have included speculation and research about hydrogen/fusion devices with 1000 times the yield of what was used in WWII. So everyone was in a high state of paranoia in 1950 when the spy ring was uncovered. This may actually have been the first and last 'level 10' nuclear secret. Since then there have been many clever ways to increase yield but nothing like a factor of 1000.

  • Level 9: detailed plans for an existing device. Right after the first bomb was used thousands of people around the world could tell you how it was done, even sketch an implosion device on a napkin. In that brief age the best kept secrets were about safe manufacturing and the precise level of enrichment that was necessary. Detailed plans would be a hot ticket item. These days the physics are known (and taught) throughout the world and the specs can be guessed/modeled with off the shelf software. This was probably the path NK was following when they set off the explosions in the mountain. But the essence of level 9, a fission/fusion bomb that 'really works' with any yield at all no longer deserves to be secret.

  • Level 8: Techniques and devices to significantly increase yield. And significant doesn't mean as much as it used to. For awhile they were trying to balance payload and lethality of single weapons, but MIRV (multiple independently reentry vehicles) sure solved that really quick and added a gruesome escalation factor to the death charts. But increasing yield by small factors that do not really change the outcome, are mainly pork barrel items in black budgets to encourage the decommission of old designs and the bankrolling of new one$.

  • Level 8: 'Credible' government contingency plans for offensive and defensive nuclear strikes. We write them, they write them. These are the kinds of secrets that can leak and be discovered by the adversary, and even if the plans turn out to be West Point student exercises they can nevertheless drive production and escalation to the brink of global disaster. Their poison is not in the details but in the way their mere existence can provoke governments and citizens into distrust.

We honestly believed the Soviets were crazy and they believed we were crazy also. Both sides were wrong about that, and both were right. Nowhere is this better demonstrated than the (must see!) documentary, The Man Who Saved The World On 26-Sep-1983 Stanislav Petrov received a false indication from a satellite early-warning system suggesting multiple launches from the United States. Although the systems left him no reasonable possibility for verification he decided to delay reporting the launch as 'confirmed' until there was corroboration from other sources. It is entirely possible that had he simply performed his job, the error could have triggered global disaster if it had passed into the hands of officials in a high state of anxiety over their own contingency plans, and any that had been leaked from US.

  • Level 7: Credible targeting information. The Cold War biz used to be a geography game. In the earlier days of large land-bound missiles first strike target coordinates were meticulously sought and maintained. Silos and command centers and the military bases around them would rate a red star. The whole objective of these strikes would be to help end the war and begin peace sooner (figuratively) by disabling the enemy's capability. Washington DC was probably a lower priority target because of all the useless people there. Any smart enemy would know that if they are eliminated their replacements would be worse. But since nuclear missiles were fitted to submarines the land war is over. First strike land targets are no-brainers not worth being secret. The ONLY remaining level 7 information today might be the exact coordinates of submarines at the moment. And I'll wager that submerged battle-ready submarines do not even report their exact positions. Why would they do that?

... EVERYTHING ELSE I DROP TO LEVEL ZERO because they are just facts (or misinformation) about the world as it is and people need to make informed decisions.

  • Level 0: All other information that is either common knowledge, cannot be corroborated anyway or is moot. There is a whole SHITLOAD of this. Who's got nukes, who's enriching uranium. At one point even proof that Israel had them was secret because they'd gotten help from us. Anything related to enrichment because there are credible (and excellent, for energy and research) reasons why anyone would enrich to 30%. And there are so many players behind the Nuclear Iron Curtain today (historically France? Pakistan? China?) that anyone that really wants it, can get it anyway,.

  • Level 0: Dirty bomb shit propaganda. Watch out because this is a terror weapon that does not even kill beyond the blast radius. The most likely false flag weapon, useless for anything else. It would affect real estate property values until the cleanup is done. If you want to start wars over your neighborhood property values be my guest. But actual people can just walk away and shower it off. As to the nuclear seed to make the dirty bomb scary by making Geiger counters buzz, it's everywhere --- active isotopes are used in medicine and industry. I have a feeling that they are about to capitalize on TDS and general ignorance of nuclear to push their antiTrump and Climate Wind'n'Solar'n'Natural Gas agenda.

  • Level MINUS ONE: Any myth that the civilian thermal-spectrum designs in use today to generate electricity can be practically used for weapons. Except of course Dirty Bomb, see above. Too much ground to cover and it's really fascinating. Start here.

Unless the Document is dated AFTER he left office, it does not matter.

Even if he did not in fact declassify it, they will never be able to prove he did not do it before leaving office, as he has that absolute power and can simply declare that he did in fact declassify any documents that they find.

Remember, he brought a lot of things there while he was president. He did not attend the state of the union, and ended his term right at MAL.

Declassification doesn't equal automatic public knowledge. The FBI is attempting to cover up their own crimes by falsely claiming classification, and it sounds like the National Archives is in on it.

Side note, any documents can be upgraded to classified material, especially if the the document and the information in the document is not public. This can occur simply because of a name on the document and the presidents name is way up there on the list for why a document is classified. This whole thing reeks of bullshit as it would be unlikely that anyone in their circle would take a marked and signed for document. If the documents we originally classified and marked they would have been retrieved immediately not 2 years down the road and if it's the other way around the document controller would be the one going to prison.
