The important take away here is that even if the town was wholly owned by a private entity they act as if they were the state in the punishment of distributing religious material and both the 1st and 14th amendment applies. Because Twitter is a public square and people use it to distribute information that would normally be protected speech then enforcement of those materials by Twitter puts them into the realm of acting like the state (on top of the part where the entities that are part of the federal government and established political parties directing enforcement). Thus the 1st amendment would apply. Of course this is mainly about criminal punishment and I don't think Twitter is punishing people with legal recourse. But I think the idea is still there in that punishment is being locked out for merely stating objective facts. There's a window to argue.

There was a retired folks home, and they worked with the government, as in at the behest of the government in doing something with social security or medicare or some such... at any rate, SCOTUS found that a private entity working as an extension of the government in violating civil rights, is in fact the government and are bound by the same guard rails as the government.

I believe another case may be relevant too regarding a company-owned town (Marsh v Alabama). The important take away here is that even if the town was wholly owned by a private entity they act as if they were the state in the punishment of distributing religious material and both the 1st and 14th amendment applies. Because Twitter is a public square and people use it to distribute information that would normally be protected speech then enforcement of those materials by Twitter puts them into the realm of acting like the state (on top of the part where the entities that are part of the federal government and established political parties directing enforcement). Thus the 1st amendment would apply. Of course this is mainly about criminal punishment and I don't think Twitter is punishing people with legal recourse. But I think the idea is still there in that punishment is being locked out for merely stating objective facts. There's a window to argue.
