Can someone explain why this is not the rule already? Pumping oil inside a state is constitutionally speaking state business. Even assuming some federal law covers this, if it is not in the constitution, a state law can be passed that overrides this.
The simple answer is that Red states get their orders from SCOTUS and they give up.
Constitutionally, States are supposed to tell the federal government to fuck off when the feds--Congress, President, and SCOTUS--violate the constitution, but we've devolved into a subservient relationship and there's zero conservative states willing to make a real fight of it (but clearly blue states have no problem banning and re-banning guns every other week).
This problem should probably be a priority for local governments. Pass laws that conflict with any federal law to allow drilling. The SCOTUS we have now is probably the best chance we have at upholding the constitutional right for states to legistlate non-constitutional issues and invalidate/override any applicable fed law.

I have hundreds of acres of minerals (oil) in several states and nobody is knocking my doors down to lease them. Maybe I should set up a "Go Drill Me" site that would put mineral owners in front of a lot of small investors, like these startup companies do. Want a piece of the oil action? Put $100 or so into the fund to get leases and start drilling. All profits divided among the investors proportionally.
I am part of a land owner group and it's still not working. I looked up the NAPE Expo that will be held in Houston next year and I will get more information about it. Thanks for the info.
I don't have an estimate of the bbls but it's about 10 shale layers almost on top of the Las Animas Arch. Some big companies around us are doing very well by fracking the tight oil in the different layers. I am getting frustrated trying to get someone to 'frack me, frack me hard'... LOL.
A normal frac play requires at least 2 linear miles of contiguous surface rights. Basically 2 miles down, two miles out, staying in a payzone that's about 20 feet thick. They can't turn the horizontal leg too steeply, so need more room, about 2000 feet. That's why you need more land. Even if you have a dozen friends all it takes is one holdout and it falls apart.
