It's an act of Congress. Why is there a Congress? Why does Congress have the authority to make law? There must already be some foundational documents that specify how the country should be run/initialized. Almost like the country was already given structure, or founded at that point. ;)

Your reading comprehension needs work. I said that the constitution is a legally binding document, but "to ourselves and our posterity" makes no such racial distinction. Again, ignorance in contracts showing. If it's not in the contract, it's not legally binding.
