Rakesh has 60 days to either find another job/sponsor, or he packs his shit and goes back to Pune.

Note - With very few exceptions it will take a month just to get that first interview in tech these days, three weeks or so to get an offer, and then the 3-6 week process of getting that H1-B re-sponsored (assuming shit isn't jammed-up because the relevant government agencies are swamped all to fuck right now due to the layoffs...)

funny thing, I'm seeing more and more H1-B workers deciding 'fuck it', and moving back to India anyway. They realize that while the promised $90k/yr is more than they've ever seen in their life, $90k/yr in most coastal cities is poverty wages these days.

90k/year is rich as Hell where they're sending that money. Americans in the same positions in the midwest are making a little over half that. These jobs were supposed to be meant for skill they couldn't find in the states, but that's not at all what it's used for.

Oh, they typically live in the cheapest, sleaziest apartment they can pack 4 roommates into, then send every spare dime back to their homeland... but you're not going to raise a family in the US that way, that's for certain.

Most H1-B's pull off the same trick the illegals do: send every spare dime home to the wife and/or family, then go home after a couple of years to use all that money to open a business (or if home is enough of a shithole, just live off the savings and be set for life.)

no they do not get a tax break, however the really smart ones with great tax attorneys will claim upon leaving America that their native country is domicile is in India and will pay Tax in India and claim back the tax they paid over their work time in America. This is how Google/MS/Energy Companies/Apple never pay tax in America because they claim to live and pay Tax in another country and legally you can not pay tax on earnings twice but rather Tax in the nation you are legally domiciled in.

I quit consulting in tech partially to get away from entire teams of poos. Being the only White dude on a team was getting lonely and frustrating, especially when I had to fly out to the client for the privilege. Now I have a nice remote job working for a company doing the same job but getting paid nearly twice as much.

Was great...until I was assigned a role to help manage a project by a vendor...full of Indians that are at least 50% bullshit.

This needs to change.

Someone needs to enforce the rest of the amendment that states "subject to the jurisdiction thereof". It was never meant for those born here whose parents are not citizens or nationals to become citizens, and we are likely the only country in the world that allows this.

permalink parent save report block reply
▲ 2 ▼
– mty_green_go 2 points 66 days ago +2 / -0

we are likely the only country in the world that allows this.

Nope works the same way in Mexico. If you are the parent , child, or sibling of another Mexican citizen or Mexican permanent resident you can also apply for citizenship. Can't speak for other countries but I do know Mexico. Koreans are doing the same thing down there at a very fast rate. 10 yrs ago you wouldn't see Koreans anywhere in Mexico outside of tourist destinations and now they are in every major city.

permalink parent save report block reply
▲ 2 ▼

What I meant is birthright citizenship.

I believe most countries in the world require at least one of the parents to be a citizen or a national before they confer citizenship on Their offspring that is born in that Nation.

Currently in the US the courts have more or less ruled that if a child of anyone other than a diplomat is born in the US, that action alone confers citizenship upon The offspring even if neither parent are in the country legally. That is why the Constitution says subject to the jurisdiction thereof because that is supposed to mean lawfully present in our country, and not immune from our laws because of being a diplomat.

permalink parent save report block reply
▲ 1 ▼
– stormybanks 1 point 66 days ago +1 / -0

Surprisingly, most countries in north and south America give birthright citizenship (jus soli). In the US, it is bring granted by a misinterpretation of the 14th amendment, but in most other countries in the Americas, it is explicitly granted.

▲ 2 ▼
– Aoikaze2000 2 points 66 days ago +4 / -2

Well, if their goal is to become an American citizen... why should they need to jump through the hoops if they'd be a net positive for the US?

However, if their goal is to syphon off wealth and send it back home... then they should go back from whence they came.

Those kind of proposals are only made during election season, knowing that they have almost no chance of actually becoming a law.

Just like how DACA seems to be in the news right before an election.

It’s just to get votes and that’s it.

H1Bs have lower flight risk than their American counterparts. If they hate their job, the options are either to move to another employer willing to sponsor them or leave the country

permalink parent save report block reply

The H1Bs also cost a significant amount , min 10k and possibly more to sponsor.

permalink parent save report block reply

For corporations, the sponsorship cost makes up for itself since H1Bs can effectively be forced into doing so much unpaid overtime.

They really need to just eliminate this visa. Like let all the existing ones go to term, but never issue it again.

And then go fix the immigration system because if there's people that will be adding to the tax pool that want to come here, and they also want to be an American, then we should figure out how to make that work and make them citizens paying into the tax pool without it taking over a decade to do that.

I wouldn't worry about them. Plenty of other roles unless you're looking to be a top 1% engineer. Those people aren't gonna be competing in the same market as most. The ones they let go are likely HR, marketing, etc. Most of the engineers either got to stay or are gonna demand an unrealistic salary from other companies. This may actually be a better time to undercut those people and get your foot in the door.

Because the US gov is effectively subsidizing H1-B employment, the company gets to pay shit in return for granting them access to America and all the associated benefits of living here instead of Bangledesh. And second, because foreigners have no loyalty to America or no concept of American values, they have no ethical or moral problems doing the dirty work of subverting American democracy that is the reason that big tech is allowed to exist in the first place.

Basically a corrupt and broken system that benefits the ones making the laws at the detriment of every other citizen. Which is an interesting concept that should be baked into whether a law, policy, or whatever is valid. Does it aid a small minority at the detriment of the greater society. I remember about 10 years ago I found out a friend of a friend got hired for Google. And all I could think was "wow that's surprising, I thought they were a weirdo idiot, but secretly they're a genius, go figure. "

What I should have thought was "we are living in a communist cesspool and society is going to shit."

It's fitting irony that they'll be rehired into some third world dumpster fire bot farm and will be forced to teeter on the cusp of financial ruin while lying to their friends and family over the holidays when telling them they're still in Big Tech.

These people that are getting fired from google are making out like bandits.

Some are getting 8-10 months severance.

Let’s say you make $400k, like some of those useless fucks did.

Let’s say 9 months.

180-190 after taxes. Get a new job.. invest that 150 and you have 1.6m

Google will write it off as a loss…meanwhile…

NY will pay you back now on Covid supply costs, like paper towels and hand sanitizer…I just saw an ad today saying reclaim cost for keeping employees during Covid, the ones you forced to vax or how about contractors? Does hiring someone who already pays tax subdue your taxes…. Well yes, it does, but we’re gonna now amplify that under a govt commerce incentive

H1Bs get fired last. They are generally cheaper than Americans.

So it's likely that the street-shitters are still collecting a paycheck.

H1-B needs to die. no more farming in temporary contract-length foreigners until all American tech workers have a job...and even then you need to provide a damn good case for it. Invest in training for employees, pay a salary people can actually live off of and no shit-canning people after the project is over to prevent having to offer benefits.

– defektiv 2 points 66 days ago +2 / -0

Even when you get beyond the H1B abuses, you still have big tech hiring massive amounts of contractors via proxy offices in other countries. They save so much money outsourcing to those outfits that they often end up building brand new offices in those countries for the proxy work forces while selling products out of the US and reaping the benefits of being a US based employer.

H1Bs? They're probably getting promoted! Our dogshit company didn't even go that far, they just hired a bunch of outsourced Indians who don't even live here, to basically fuck around.

They can't speak correct English, don't care about our country or its people, have very little incentive to care about the job itself, are in an area known for scamming Americans, try to get us to do their work which was previously ours, and have access to all important information no American citizen would enjoy knowing they have.

Meanwhile, the workload for those based in America is the smallest it has ever been, yet our metrics left unchanged. I assume a big hit is coming in the next month or two.

These big tech employees should be happy. They worked hard to get Biden installed, and they got what they wanted. Sure the economy is shit, and we all warned that would happen, but it was really fucking important to them that Biden get installed.

Standard operating procedure for all companies now is to both lay off permanent staff and reduce contractors at every "down turn". When times are better they negotiate with the outsource providers to increase as needed and sparingly hire perm staff. One of the perks for them in any lay-off is reducing permanent staff.
