Riddle me this batman - if the feds refused to charge trump for the underlying "crime" the minute he left office, how can the DA use that same non-crime as the basis for bumping the misdemeanor (past statute of limitations) to a felony. Particularly when most legal experts (including those on the left) agree that the underlying crime that was being furthered by the falsification of records would have to be a state crime not a federal one?

DO you think that this is something the prosecutors do not realize and will immediately be thrown out by the judge? Michael Cohen went to prison for the underlying crime. In his indictment, Trump was labeled as Person #1 and was an unindicted co-conspirator. No idea why the feds didn't charge Trump. I assume they thought it was more trouble than it is worth. But it doesn't mean that there are no merits to the charges. Otherwise, you'd be admitting that allegations about Hillary and election fraud are baseless because no charges were ever brought. So I doubt that is an argument that you want to make.

And there is no dispute abut that matter The only question is whether that can be blown up into something bigger and more significant. And that's what the Manhattan DA is betting he can accomplish with a jury.

That's not it. He used personal funds to pay Cohen. The left is trying to claim that the payments should have been labeled as campaign payments because they benefited trump, therefore they benefited his campaign, therefore they should have been campaign outlays and marking them as "legal fees" was fraudulent. Unfortunately for the prosecution, campaign finance law strictly forbids these types of payments as campaign finance spending. Like,if trump had tried to pay Cohen with campaign funds for doing this, that would have broken campaign finance laws.
So by definition, these were personal payments made with personal funds. The feds already determined this, which is why they didn't pursue charging trump. They waved their hands a bit, but if their had been an actual federal crimes they would have charged him. Now the DA is trying to say the thing the feds determined wasn't a federal crimes, actually is a federal crime. Which is what would boost this from misdemeanor to felony. But most legal experts say the underlying crime would have to be states not federal, so even that horse shit is dead on arrival.
I've seen so many left wing, but honest, people shake their heads at this and say it's a stupid prosection and makes all of their other cases look bad by association.

To be honest they go through it it will backfire. There's so many people that didn't support Trump in 2020 that now are legitly saying yeah he's being targeted.
