The stupid part is that he nor any part of Florida law enforcement wouldn't be involved with this at all, since Trump has that Secret Service detail. If New York indicts, Trump turns himself over to his Secret Service detail and that detail handles everything from there. There never would have been any extradition because Florida law enforcement would never have arrested Trump in the first place, nor would NYPD fly down there to do it. That's what the Secret Service handles.

So, basically, DeSantis just tossed himself on that sword for absolutely no reason, and it's looking like he's flopping around on it now to drive it in further.

It's also stupid of Gaetz saying what he's saying now, since he should know this just like DeSantis has to have known this is how this works.

If he limited himself to talking about extradition of regular citizens, that'd be one thing, but he specifically also mentioned the President of the United States. He fully knows that's not how that works because of the Secret Service details that former Presidents have. Florida wouldn't be extraditing Trump, the Secret Service handles all that. The governor of whatever state the President is in would have no say at all in the matter.

Nothing in the current situation rises to the level of what The Constitution clearly spells out in the referenced passage.

Trump did not "flee from justice". Trump did not "commit treason or a felony". He wasn't "found while on the run in another state".

This is a patently obvious political persecution and DeSantis had an opportunity to prove he's who he says he is by refusing to allow such treatment to negatively affect a Citizen/Resident of the State of Florida.

A competant attorney could easily argue that Article IV does not apply because President Trump did not flee from justice so the standard does not apply. He is a resident of Florida and is domiciled there. Further, statute has tolled and nondisclosure agrrements are legal contracts. This person would argue about the definition of the words flee and justice. A really good litigation attorney would take it further and would argue the meaning of the word "from."

There is no legal precedent of a former President being extradited. You cannot rely on prior case law since it does not exist. Strict construction has been nearly dead legal theory in the judiciary for 50+ years. Democrats would view this as a case of first impression. They would push and push and push against the Constitution. They are unrelentless. In this situation, you want to court to decide so Republicans can go after former Presidents later, if need be. Plus, politically you want to make it difficult for Democrats to carry out asymetric politcal and economic warfare. Make them have to defend this action. It may not result in a court win but you don't put up no fight and say whelp the constitution or precedent says we cannot do this so we will just stay out of it because we have better things to do. You need the Democrats to expend capital and resources in having to defend their actions. Republicans need to show they will take on every legal battle because you don't know what will happen. We cannot get court victories unless we go to court. The law gets exceptions added to it all the time. This could be one of those instances.
