No shit. As of Monday, cohens former legal advisor was able to enter into evidence statements from Cohen that Trump didn't even know about the payments to Daniels. Given the conflicting statements and Cohen's history of perjury, there is literally nothing left.
They already knew that this was the case as Giuliani already exposed it all in 2018 when they tried to charge Trump with using campaign money on this exact same thing with Stormy. The same thing came up, Cohen had paid, Trump eventually payed him afterwards from his personal account. So they already KNEW this, and they still went with it now in 2023 anyways. Either they know something else, or this DA is going to be in a lot of shit.
There's nothing linking subsequent payments to Cohen to the stormy Daniels payment. Cohen submitted invoices. Trump paid him. Cohen is an attorney. Those payments should be booked as "legal fees", exactly as the trump corporation did them.
The only first hand "evidence" that Trump even knew the payment to Daniels occurred are claims from Michael Cohen himself. Everyone else claiming that Trump knew about and authorized the payment are parroting Cohen's story second hand.
Given that there are 100% documented instances of cohen claiming that Trump wasn't a party to the payments and knew nothing about them, it is impossible to build a case around him. He is a convicted felon who has a documented history of lying under oath. The DA is digging around for a witness that will refute the testimony from Monday, but I don't see how you put the genie back in the bottle. The documents exist, as do Cohens convictions. Additional witnesses won't change any of that or somehow magically restore his credibility.
And beyond that, even if you could establish that Trump knew about the payments, there is still no case. I have never, in my entire life, seen such incompetence from a prosecutor in a major jurisdiction. This idiot makes the duke lacrosse prosecutor look like John Marshall. If the DA brings this case, he will eventually be disbarred. Hell, at this point he might be disbarred even if he doesn't indict.

I did not read Trump correcting this statement. Giuliani was also Trumps lawyer when he said that. Stormy also came out and put out a statement saying she never had an affair with Trump. The bottom line, and which Giuliani proved was that Trump never paid Cohen with campaign money, that Cohen acted on his own accord with the initial payment.
Also, go back and look at Rudy's statement from that time period. He was referring to how Cohen approached the transaction when he invoiced the Trump corporation for the settlement amount plus extra for himself. Nowhere did he admit that Trump knew about the settlement or authorized Cohen to make a settlement and bill it as legal fees for reimbursement. The "receipts" were simply to prove that any payments that were made to Cohen came from the corporation, not the campaign.
The trump corporation has tens of millions of dollars in legal fees each year. I highly doubt anyone in accounts payable felt the need to run into trumps office with Cohen's $150K invoice and ask if it was all right to pay it. Particularly given that Trump was president at that point and had mostly stepped away from his business.
So the only thing we might be able to establish is that Cohen made the settlement and then submitted for reimbursement plus a cut for himself with a generic invoice for "legal services". And that the trump corporation paid the invoice. Nowhere in that fact pattern does it establish that Trump knew about the settlement, authorized it, or knew that he was somehow reimbursing Cohen for it.
