In loans like Trump’s, the appraisal will then go through an internal review process. Many times this process results in the valuation being reduced. No way any financial institution will rely on property tax valuations. If they did, not only would they being violating federal law, the loan would then be tagged and have to be reported to the Feds in the bank’s call report.
This in and of itself is reason to overturn the ruling. In a summary judgment motion the judge cannot resolve disputed facts. Any factual disputes MUST go to a jury. The judge overstepped big time. He basically made it up and ignored the law. Trust me. I have written and even ruled on these motions when I was a clerk.
