The race and national origin of the two people should not be relevant to the judicial system. Who cares if business owner is a Ukrainian immigrant (presumably legal). And who cares if homeless man told business owner to go home. Those are just words, protected by 1A.
Punish the actions, not the words. Littering and threatening with box cutter are crimes that should be punished with fine or time and should not be punished with essay writing, which is the opposite of 1A. Requiring the essay is actually compelling correct thought/speech rather than protecting free speech.
We don’t have to like each other. We have to not litter or vandalize other’s property, and not chase people with box cutters.
