The appellate body is like an appeals "court" for WTO disputes, but they have been regularly overstepping their authority:

  • attempting to make rules rather than apply them
  • attempting to create precedent, which they have no authority to do
  • regularly taking longer to come to a decision than the mandatory 90 day limit
  • members regularly remaining on the body past their termsite

Therefore the Trump admin has been blocking new appointments, only 3 out of 7 members remain and 2 of them term out on Dec 10. The Body requires 3 members to function.
