Marbury vs Madison was a power grab by the Judiciary and led to the implied rights and living Constitution that turns the original intent on it's ears. That is not the case you want to cite to retain your 2nd Amendment rights.

I would argue the notion Marbury is evil. Marbury suffices to strike down illegal law, it is not a perfect theoretical case to preserve our separation of powers but it suffices, I think.
