My understanding is that it'll require a vote to change the rules in order to take up the trial without having formally received it by the house. Changing rules is tricky business. I, for one, would be very careful about what precedent is being set in dealing with a rogue speaker of the house.
Taking the "Impeachment isn't valid" path is more dangerous to Trump than simply acquitting him in the Senate.
The democrats have already shown that they don't care what the law or rules say and are willing to disregard them as long as it pushes their agenda. If something is "dead," they can simply vote to make it not dead and then pass impeachment later if they ever get control of the Senate.
