Sources say Collyer, 74, is leaving her presiding judge post because of health reasons.

While Collyer is stepping down as presiding judge, she will remain on the FISC until her term expires in March 2020.

In an order unsealed Friday, Judge Rosemary Collyer asked the Justice Department to identify steps to ensure the accuracy of those filings and whether the unnamed DOJ lawyer was ever disciplined.

I think that is Boasberg. Not sure who appointed, but he did raise concerns about the process and much more recently than Collyer. Sundance at Last Refuge had some posts about it a couple of months ago. It kinda got lost in the lead up to Horowitz I think. Maybe not ourguy but seemed to raise valid questions.

Can I ask why the f*ck does the FISA Act grant the Chief Justice unilateral authority to appoint federal judges to FISC, in quite obvious violation of the Constitution?

Every OTHER federal officer is either appointed by the President, by an executive Department Head (for members of that department), or by the "courts" (specifically, the US District Courts of Appeals, by majority vote of the sitting judges, for Magistrates & Bankruptcy courts).

The "chief justice" IS NOT "the court", just as the "speaker of the house" IS NOT "the legislature".

There is NO carve-out in the Constitution for a single person to unilaterally appoint Judges to anything, nor is Congress ALLOWED to create said carve-out.

This unconstitutional appointment process should invalidate the entire FISA Act.

There isn't such a thing as a good FISA judge. They approved whatever crap the government passes them. FISA shouldn't exist at all.

  1. She wasn't "an ally". Nunes submitted concerns to her 2 years ago; she sent him a 4-sentence reply basically telling him to fuck off and have a nice day.

  2. She has an obligation to pay attention to the veracity of the materials presented to her. Remember: bullshit in...bullshit out. She's the presiding judge and bears the gravest responsibility for ensuring that her assent doesn't ruin innocent people's lives (like Flynn and Papadopoulos).

  3. She accepted a ridiculously fabricated tissue of lies and granted a surveillance order and then rubberstamped that request 3 more times and now idiots like you are trying to praise and pedestalize her.
