I have typed this out in another post where a citizen had the question of "Has President Trump been impeached yet?" I went through the Constitution to find the process. I will paste it below.
Lets take a look at the Constitution of the United States of America to answer your question.
Article 1 Section 2
Selection of Officers; power of impeachment
- The House of Representatives shall chuse their Speaker and other Officers; and shall have the sole Power of Impeachment
(means they get to bring the charges, which have been done but not yet delivered.)
Article 1 Section 3
Senate to try impeachements
- The Senate shall have the sole Power to try all Impeachments. When sitting for that purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members Present.
Judgement in case of impeachment
- Judgement in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of Honor, Trust or Profit under the United States; but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.
(This means it is the Senates job to do the "court" part of the impeachment. Innocent until proven guilty per se.)
Article 2 Section 4
All civil officers removable by impeachment
- The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.
(President Trump did none of these. They are made up accusations from the Dems and they attempted to get Bribery but couldnt get it. Now we are looking at Quid Pro Joe and Pelossi's for Bribery. All over the news recently.)
