Plus, Barr’s folks can always step in with a motion of their own, requesting that sentencing be delayed until after Stone’s motion is considered.

If Barr is having a third party attorney reviewing the case, why not have that attorney file an emergency stay-type motion?

Seems like not all the cards are being played that should be in the interest of justice. The rogue four prosecutors and what they did — in a neutral Department of Justice and in the interest of Justice — should have been enough for the DOJ, as an “officer of the court”, to put an immediate halt to all further proceedings to investigate.

A judge can issue a "judgment notwithstanding the verdict", but this is very rarely used (for example if the jury's decision does not correctly apply the law).

If she is moving forward with sentencing, then she has no problem with the jury's verdict.

Not much — would have to go through a dicey and futile appeal process. That’s why the prosecutors (in any jurisdiction) can get very corrupt, very quickly.

A possible exception is if there is evidence of criminal activity on the part of the judge or those working in seating the potential jurors. If the jury is rigged, there is an outside chance of arresting those involved and getting a reversal based or suspension of sentencing.

Another approach is to go immediately to the appeals court for some sort of mandamus to order the trial judge to not move forward. Whether this is possible in DC Federal, and the procedure and options, would have to be looked at.

Barr already played his card: told the judge that DOJ takes no position on recommended sentencing. So, the judge has a pretty free hand.

Plus: as an officer of the court, it should be the DOJ’s duty to immediately inform the judge of any illegal activity or malfeasance on the part of the DOJ and its prosecutors. I did not see Barr do this.

If it comes to a pardon, the trump should play like the Romans: ask folks to show up in the streets if they support / want Stone pardoned. A large crowd will minimize the political damage of playing the pardon card.
