Don't think anyone is debating they CAN. As far as I know, the only legal action that can be brought would be (if I remember right) section 230 of communications decency act. It stipulates, simply, that forums and user generated content are "platforms" and immune to lawsuits and legal action if reasonable efforts are made to remove statutorily illegal content. Theoretically, by curating and making editorial decisions regarding their content puts them in the "publisher" category, which exposes them to legal liability. I'm not sure what the precedent or interpretation of this statute dictates as the line between these two categorizations, but they're certainly pushing their luck imo.
