Serious question for any based lawyers on here. What is the legal threshold an “interactive computer service” would have to cross to become a “publisher”? Seems to me that the most effective way of making a case here would be to... actually make a case while making a shit load of noise. Get attention, but also put together and corpus of evidence and compelling arguments (based on said evidence) as to WHY and HOW Reddit has crossed that threshold.

Seems to me that the best way of getting any action (however unlikely) is to present something that is basically shovel ready. Give whom ever would investigate or action something like this “every reason to say yes” (such as doing a lot of the leg work for them).

SOOOO... What is the threshold (generally or in this instance specifically)? Some quick research shows the “three prong test”, and that seems intentionally broad. What would be a “smoking gun” that would immediately strip Reddit of Section 230 protections? I have my own thoughts here, but I’m not a lawyer and y’all are a special breed... so anything I think here is likely wrong or at least undeveloped. Maybe I’m ignorant, but I believe there’s gotta be some specificity between the two given the implications.

Based upon the answers to that question, is there any general interest in a little research project? Again... it seems to me that reporting is one thing but reporting with sufficient evidence for a Pede on the DL bureaucrat to do something is next level winning.

You can't sue Reddit because you have no damages to claim. You aren't paying for the service, and they are in no way liable to help you make money. The only way we get Reddit into the court system is by removing Section 230 protections from them making them a publisher, like a newspaper, or magazine. Think about this, a News paper that advertises to children, r/Teenagers, and also has a place for teenagers to post their own pictures nude r/legalteens, where it is up to Reddit to both stop children from uploading nudity, but also to stop children from viewing nudity. Right now, section 230 keeps them out of liability from that in the same way Comcast is not liable for anybody downloading child porn. But, the thing is, Comcast does not stop you from up voting because you like Donald Trump. CNN does that. CNN is a publisher. CNN does not provide children with access to porn. Comcast provides children with access to porn. It's even worse when you consider that u/spez is actively using 230 protections to interfere in our elections. Imagine if your internet provider cut off access to thedonald.win because they don't like Trump. You would be pissed, but the internet provider would also be curating what you, the customer can and can not see. Which is what Reddit is currently doing on the_Donald. To fix this we need 1 of 3 things as far as I can figure.

  1. FCC removes section 230 protections from Reddit, and they get held liable for everything on their site. Imagine if CNN published content in the way of wanting to kill the president. Reddit does that every day, all over the site. The CEO of Reddit would be held liable for that content without 230 protections.
  2. FEC looks into election interference. This seems like a joke to some, BUT Reddit is the 19th most popular site in the world (https://en.wikipedia.org/wiki/List_of_most_popular_websites) and is the 3rd most popular social networking site in the world. It has a huge reach... of cucks and communists, but still. By illegally using section 230 to do what spez said he could do, interfere in our election, he is clearly violating the law. If you think Russia buying some adds was bad... This is campaign contributions totaling Billions for the demoncrats buy simply having Bernie on the front page, and not allowing Trump on the front page. Millions of people go on Reddit everyday. They don't notice that Trump is no where to be found, and that means Reddit is advertising to millions of people for the demoncrats.
  3. Congress can start an investigation. We can give them the info, and they can hand that info to the FBI, and DEMAND that the FBI look into everything. That would be the feds taking the servers of Reddit, and checking on 1 and 2. If the Feds deems either 1 or 2 legitimate, the CEO at minimum goes to jail for a long time. We do not control congress right now. So this is not the best option. But in reality, the government is so cucked the fuck up, options 1 and 2 aren't looking that good either. Trump ran on draining the swamp, I'm not sure he got to draining either the FCC or FEC yet. Feel free to ask more questions.

My understanding of your response is as follows;

  1. Suing is not a possibility (nor is that what I’m thinking... more putting together a quick but thorough brief of existing evidence to show that Reddit is more acting as a publisher).
  2. The two “regulatory” bodies that could take any action here are the FFC and FEC. Humble pedes getting any of them to seriously look at something is less than likely.
  3. Congress could start an investigation. This seems, to me, like the most feasible option.

Therefore, what information, in your opinion, would best lead to an interpretation that Reddit is acting as a publisher? My perception here is that most friendly congressmen (with a few exceptions), don’t fully grasp technology or social media. Therefore, any information sent to provided to them needs to quickly encapsulate both the nature of Reddit, and how they are either interfering or acting as a publisher. To that end, I think that finding a few “smoking gun” posts, comments, acts, etc. may be the best bet. Put together a quick brief referencing and including the aforementioned evidence, and get it over to some of our hero’s on the hill.

So let’s assume a few things. One, we can get said brief (or report, memo, etc. I’m calling it a brief in the business sense not the legal one so that could be the wrong word) to the hands of one or more relevant congressman. And two, a few members of this community are willing to collaborate on the development of said information (again, nothing terribly complicated, but with sufficient information to sway opinion).

If we assume the above as true, what would be the most impactful posts or actions to display to quickly make a defensible argument that Reddit is either a publisher and/or illegally interfering in elections? Can you think of a hypothetical off the top of your head? Something that, if found and properly explained, is more likely than not to lead a friendly congressman to the desired conclusion?

I’m rather serious on this one. I don’t think it would be a very heavy lift to accomplish this. Because it may be relatively easy, I’m less concerned about the risk of it going nowhere. A well crafted letter is a very powerful instrument. I’m wiling to put in the time, and I imagine some members of this community could pull have archives of information that could fit the bill.

As I ask in any conversation about a subject I don’t fully understand, please tell me I’m totally off base! This pede is motivated, but my mama thought me intellectual humility. Again, your a hero! Thank you for your time and effort.

The front page is a clear example of election interference. Not 1 positive mention of Donald Trump but tons of pro Bernie content. How do we prove that Reddit is doing this intentionally? Well, our sub was quarantined, and not allowed on the front page, our pedes were getting notices for up voting legitimate content, our sub was taken offline on the day of a demoncrat debate 1 week before super Tuesday, and our mods all are being replaced. (The ones that stay are boot lickers). This amounts to campaign contributions. If they didn't take an active hand, by having admins take over our sub, they may have had an excuse, maybe. But imo quarantine by itself would have been enough to say they are actively interfering in the election. As a platform, they should not be actively curating what is on the front page, but we now all know that they definitely do.

Imagine if your internet service provider just stopped you from accessing thedonald.win. You can still access it on your phone, but not your computer. You've hooked up multiple computers, and not 1 can access thedonald.win. How do you prove that??? Well, that is the state we are in. Can you post on the_donald? NO. I know that and you know that, but how do we get that to someone that cares.

The thing about this is your internet service provider is protected from what you do online, illegal activity, so long as they don't currate what you do. That is section 230 as posted above. Reddit was pretending to allow the users to dictate what is on the front page through up votes. That is not at all what is happening now. How do we prove this and to who? The FEC, FCC with complaints. Especially the FEC, if they figure out that Reddit is advertising for Bernie Sanders, which you and I know they are, well Reddit is SCREWED.
