Wow. I used to fly model planes. Built a few from balsa when I was a kid. We had fields where we would fly. This is fucking absurd. Serious modelers stay the hell away from big aircraft and are way below flight paths. Hope this doesn’t pass.
For real. Are they telling me that all the model airplanes I have and their transmitters need to be retrofit with a cellular connection to broadcast their location in flight? Do I need to file a flight plan to fly my shitty styrofoam airplane around the backyard?
I am hoping that this gets amended or turned down. I don't even see how this is enforceable.
It’s quite a conundrum with air rights. My recollection is that you own 500 feet up from your property (if you owned infinite air up it would make flight impossible without trespassing). I don’t know how the FAA could regulate a styrofoam craft flying 40 feet above private property. It’s absurd.
They already made the local police defacto FAA investigators under Obama.
Every cop out there is authorized to seize everything associated with your flight or attempted flight without even a phone call to a federal agent.
If you are not in with a cop to protect you, don't fly. "We got a call, we are taking this until our investigation is done. Here is the FAA flyer giving us federal powers. Oops did I just break your $4,000 gas turbine jet? Who cares."
I sat in on the FAA focus groups, they are here for Amazon Drones, not hobby pilots.
FAA : "Hey Amazon! Your checks cleared! The airspace from 400 feet to your customer's driveway is all yours!"
I can see that if I were flying a quad over my neighbors house. I haven't had a problem flying my planes out in a farmers pasture after getting permission. I just didn't want them to roll up and fine me for flying without uploading logs.
I did hear that this was a stunt to get Amazon though.
I hope they clarify this to be commercial drones or something similar. Leave the hobbyists alone.
From what I can tell with the proposed regulations is that hobbyists are going to be placed in existing air parks but they will become unavailable in about five years as the licenses will not be renewed. It is effectively strangling the hobby.
They really are putting a nail in the coffin to quads with a new rule, you cannot fly something you have built or modified to try and qualify for the new regulations. Old quads cannot be retrofitted and only new ones with transponders and other shut down features are going to be allowed. Millions of dollars in hobby equipment and r&d are going to be grounded in the near future.
You are right about cops rolling up on you, it will take just one concerned passerby and you've got an FAA violation with a huge fine.
The other people I see happy about this are the manned aerial photography pilots, they want 'their' territory back from UAS pilots.
The only solution I see is radios and us talking like sport pilots do and getting ATC permissions as we fly real time. The FAA killed that idea. They have no interest in UAS pilots talking directly with their towers.
