You cannot say things to incite an unlawful riot, panic or violence. Yelling "fire" in a crowded theater when there is no fire is how one judge, Oliver Wendell Holmes, paraphrased it to make it simple. You could yell "fire" if there really was one but if you did it without a fire and caused someone harm, you will go to jail for what you said.

Interesting. I'll research this more. If you're talking about the specific example of yelling fire in a theater you may be right but it is still illegal to say things to incite an unlawful riot, panic or violence. I know that is still true.
