I have caught California's Income Tax Collection Agency, The Franchise Tax Board, in two different racketeering schemes. I tried to get the illegal activity stopped by contacting legislators. TLDR of the schemes:

  1. The FTB is illegally putting estimated tax payments into a general slush fund instead of into your account. The money isn’t put into your account until you file your return for that year; basically, the State of CA is temporarily embezzling your money. If you file late, they harass you for payments that would not be owed/impose penalties that would not have been assessed had the money been applied to your account in accordance with the law.

  2. The FTB “accidentally” misapplies money to previous years and sends you a refund, leaving the current year underfunded. Like the withholding scheme, if you file your returns late, penalties are falsely imposed. Where it gets suspicious is that it takes months to send the refunds. The refunds are difficult to identify – you just get a check in the mail from the State of CA with no letter. The refunds have interest added or are broken up into multiple years (issuing a separate check for each year), so you don’t immediately identify that this mystery money may be a refunded tax payment. The FTB has an unusually difficult time locating these particular “lost” payments, taking months or even years to locate. Once located, they will accept another payment from you and retroactively apply it to your account for the date that the original payment was made, thus correcting the underfunding problem. But it takes them months to apply the money. And the accounting ledgers tied to these “misapplied” payments are inaccurate, with missing line items and incorrect dates.

When I lived in CA the hit me with a very large tax bill for some stock I sold. The stock was an option which means I did not own the stock until I exercised the option.

Example: Option is for $50 and stock is trading at $100. I sell and make a $50 profit and immediately pay taxes on the transaction with the trading firm.

State of CA steps in and charges me taxes based on the $100 sale and not my profit from it. Then adds penalties. I then show them proof that I paid the taxes which case they then confirm by saying they see the taxes in the system in my name and drop the case as long as I pay the penalty?

first problem is they have list of all the money you gave them.

Second they do not tell you they have this list until you provide proof.

Yes, this is spot on exactly what they do! They make the "mistake," but you are still on the hook for the penalty. You can file a request for refund with the FTB, but those are almost always denied. You can file an appeal with The OTA, but that is an actual court case. Most people won't go that far because the penalty is usually a small enough amount of money that its not worth the stress/headache. And The OTA almost aways sides with the FTB, so its really not worth the hassle knowing you'll probably lose.

From my Superior Court filing page 1:

I believe that we are due a full refund for two reasons. Firstly, because the Demand Notices issued to my husband, Eric W. Grab and I for tax years 2010 and 2013 and 2014 were improperly issued. R&TC 19087 states that the Demand Notices and accompanying Demand Penalties are only to be issued on accounts with delinquent taxes. However, at no point were we delinquent. FTB improperly withheld and misapplied our estimated tax payments, making our account falsely appear underfunded. Thus the Demand Notices and accompanying Demand Penalties for 2011, 2013 and 2014 were improperly issued/imposed. Secondly, I believe our late filing was due to reasonable cause: the delays were a direct result of FTB’s aforementioned multiple breaches of duty. As such, we are requesting a full reimbursement of all penalties and fees paid

And page 6: ...the heart of our argument: Is it legal for the Franchise Tax Board to assess penalties that resulted solely from FTB’s own breach of duties?

It's the big cities that dictate all the stupidity for the rest of the state. I know plenty of Californians who are sick to shit of it. Consider the by-county vote results from 2016. True that the majority of counties seem to have gone Clinton, but outside of the LA and SF areas, it's probably a bit lighter blue than you think.

There is a reason why there are multiple movements to split the state up. The people in rural areas -- which is the majority of the state by acreage -- have no voice at all because they are overshadowed by the cities. CA is the perfect example of how important the electoral college is in the US Federal System.

I did an AMA on California_politics in November and I was viciously attacked and downvoted to oblivion because I post on T_D and T_D_CA. I wrote this to one of the "concern trolls":

"You seem like a reasonable person who is genuinely concerned, so I want to ask you a serious question. The way I was attacked for refusing to segregate myself from a particular group has me seriously disturbed. In my mind, telling me that right-winders are "others" who it is imperative that we segregate ourselves from because they are second-class citizens who deserve to be treated badly is no different than the Jim Crow mentality of the 1950s.

I know you said that right-wingers are extremists, but there are just as many extremist left-wingers out there. Look at the trans-chick who shot up You-Tube for being de-monetized and the dude who shot up the republican softball practice. If you were telling me to avoid all extremists on both sides, I wouldn't be so disturbed, but the message was clear that I needed to avoid all right-wingers because there could be extremists among them. I am sure that was the same logic back in the Jim-Crow days, too.

I genuinely am curious as to why you think telling me to segregate myself from a particular political group is different than you telling me to segregate myself from colored people or people of certain religious groups? I'm honestly not trying to pick a fight. I just want to understand your point of view better. Honestly, I am optimistic that this issue will bring both sides together since it is non-partisan. If we phrase it as "criminal collections practices by the state government" and not "paying more than our fair share of taxes because of Democrats," we'll be able to get some democrats to join in, especially democrats who have themselves been brutally harassed by the FTB.

And once people are in and see the details, they'll start to see the corruption and have an awakening. I have a friend who is from Oregon, lived in CA for a long time, then moved to a small town in Oregon. Her husband is from Michigan, they met in CA and he was in CA as long as she was. I think so. Call me overly optimistic, but I view California's government as a fortress. I am hitting on the fortress wall with a sledgehammer in one spot (the FTB). While I have a long way to go, I have done a notable amount of damage to my spot. I think if 4 or 5 other people join me, we'll be able to knock down this piece of the wall.

And I know that, even though I can't see them, there are other people who are also hitting at parts of the fortress wall with sledgehammers. I really believe that it'll only take about 5 people per agency to collapse the agency, and once enough agencies go down, the whole system will go down.

I do taxes for a family that received a little bit of income from California sources. Each year, two of their 1099s have California income withheld. And each year, we file all forms required to make sure that the withholding passes through the family LLC to the members. And each year, California repeatedly refuses to give the family members credit for their withholding. Unfortunately, the cost of fighting for those credits (multiple letters and phone calls to FTB) exceeds the value of the credits, so the clients have started just paying the bills.

They are a criminal organization, I tell you.

Short version of a longish story.

I buy a high-end-but-not-super-pro chainsaw.

It stalls constantly. Start, do one cut, stall. Restart, do one cut, stall.

Return it for a new one.

Same thing.

Find out that due to California laws, they have to ship the chainsaw idling too low to actually use. You have to turn a screw to make it actually work. If you turn the screw and get caught in CA, it is a massive fine. Everyone knows this, so they have inspectors regularly out to work sites to collect fines from the illegal chainsaws.

California Tree Felling Safety Code Regulations:

(c) Felling.

(1) The work area shall be cleared to permit safe working conditions before any cutting is started.

I filed an appeal in Superior Court of CA, so for this case, I will only get my improperly imposed penalties refunded + interest. However, I plan to also file a harassment lawsuit against them because they harassed me for years for money that was never owed. They went so far as to file a wage garnishment for $6k when they had $16,500 in hand that they refused to apply to my account.

Unfortunately, a "class" means that each and every person was harmed in an identical way, so instead of 100 identical lawsuits, you have one where the identical thing happened 100 times. Taxes are almost never identical situations since each family's income, deductions, withholdings, estimated payments and so forth are rarely identical.

The FTB is the collection agency for over 500 different government agencies in California. The fact that we have over 500 government agencies to start with is kind of shocking. Knowing that there are a lot more agencies that don't use the FTB for collections adds to the shock. But what is most disconcerting is the fact that most CA government agencies have no need for a collections agent. How many government agencies are there in CA?????

Yup. In my speeches in both 2018 and 2019, I straight out said "This is the federal crime of racketeering per the RICO Act." Both years, the FTB did not attempt to deny my claims: https://vimeo.com/user93891576

For my court case, I was advised not to say that the FTB was running a racketeering scheme since that is for the judge to decide. My job was to lay out the facts so the judge figures out "racketeering scheme" for himself. However, the advisor said this sentence on page 9 was okay:

"The reason that the record did not show “timely payment” was because FTB breached their duty to apply that money to our account. It was not us who failed to pay timely, it was FTB who failed to apply timely.

I believe that imposing a Collection Recovery Fee to collect money that would not have been due had the payment been applied in accordance with the law is unconscionable. This type of practice is what you would expect from racketeering scheme, not from a government agency."

Those fucks froze my accounts TWICE last year claiming I owed them money. If I didn’t pay they were going to take it directly out of my account. I never lived in California and had to prove I didn’t by showing several years of tax filings. Dirty fucks!

Usually, the FTB will mail these "tax due notices" to addresses that they know are old in the hopes that you moved and won't get the bill to dispute it. Then, with no dispute, they go ahead and seize your money. When I was doing research in the law library for my case, I found out that people who live out of state have no recourse to get their money back once seized. You are VERY lucky you were able to stop the seizure.

I got lucky and the gal I spoke to the first time was beyond helpful and extremely nice. She totally helped me square it away. The second time it happened I was told the first person handling my case was fired and the info I sent was never filed. I had to re-fax 72 pages of documentation to them. Not email. Fax. And since the FTB and FedEx Office are the only ones with fax machines, that cost a fortune to submit/resubmit.

I am fairly certain that the purpose of faxing is to set a high bar that is difficult for people to jump over. For example, an elderly person who doesn't drive anymore will have a hard time getting to a fax, and low income people won't have the money to pay for faxing. I can't tell you how much time and money I spent digging up old records (such as cancelled checks), driving to fax places, making copies of documents and faxing them!

I had a similar experience where I got a helpful, nice person who cleared up some of my issues. She left shortly thereafter, and I suspect she was fired over my case.

YES! So the withholding racketeering scheme can be ended in one fell swoop by passing a law that says that "All estimated tax payments have to be applied timely." It's super simple and should pass into law with no problems. Toni Atkins refuses to put this on the table. She is basically protecting the gravy train of extra revenue by refusing to do anything to stop it. Will you contact her office and ask her to put this on the table? Unfortunately, the last day to put legislation on the table was in February, so now you have to wait until September to contact her. But please, put it on your calendar to write her AND call her about it around September 10 or so.

My assemblyman, Brian Maienschein, said he'd put it on the table if I can get a big group to support me (basically, if I can bring him a voting block that will vote for him in exchange for putting this on the table). I did not succeed in getting a voting block. Whose Assembly district are you in?

Also, you may want to call the person currently running against your Assemblyman (sadly, nobody is running against Atkins) and tell them about these schemes and ask them to make my legislative ideas part of their campaign platform.

Finally, you may want to contact the local republicans to let them know what is going on. I talked to a couple people last year, and they were concerned but didn't do anything. I'm a military member who was stationed in CA. Had bank assets seized over fraudulent "state taxes owed" claim (despite ID my employer as DoD and legal residency as TX). Kept my money for 7-8 months despite local SJA and US Attorney's office involvement. TL/DR: 1) Gave money back but made me involve SJA/ USAs. 2) Kept the interest. Unfortunately, class-action lawsuits aren't normally allowed on tax matters. As I have been working on figuring out if the schemes that I got snared in were indeed illegal, I have come across a whole bunch of additional schemes.

The FTB has several policies in place that allegedly allow them to randomly assign you an income and assess taxes due based on this imaginary income. It sounds like you got ensnared in one of those. I'd love to chat with you about how they justified this unlawful assessment and why it was so hard to get it cleared up. CA FTB also invents debts as a fishing expedition. If you get a state cert and don't file taxes they assume you're a tax evader.

They make up a job, a salary, create a tax account, and then assign tax leins. Even if you're just in school or something and not working.

They only do it for a small percentage of cert textures recipients per year though

You forgot the part where they wait several years to assess the imaginary taxes due and then mail the assessment to the address you lived in at the time, not to the current address they have on file, so if you moved, you never actually get the tax assessment and don't have a chance to dispute it before a lien is filed.

But you got the part wrong about how they do it only to a small percentage of people. They do it to everyone; it is their official policy is to assume that if you hold a license or certification, you made the average income for that line of work and you have to pay income taxes based on this income they made up out of thin air.

To be honest, I have not looked up the legal code they provided because I decided that I just need to focus on the issues that affected me directly. But eventually, I am going to get aggressive about the other schemes they have going, and this issue is at the top of the list.

So let me make sure I understand what happened... your county charges property taxes on businesses? On the real estate or on equipment and such? If it is on equipment, do you not have as much equipment as the county determined you should?

I plan to go to the law library again next week to get help with subpoenaing records. I'll ask about your situation while I am there. I just need to understand the situation a little bit better.

The way you get through to liberals is by questioning how the tax dollars are COLLECTED and not saying a word about how they are spent or who is in charge of collecting (the Democrats). As much as liberals claim they are happy to pay taxes, they get just as pissed off about being racketeered into sending extra tax payments and paying excess fees (and huge fees!) as conservatives do. The beauty of this issue is it is non-partisan.

As for people who have already been scammed, you have 4 years to file a Request for a Refund of Penalties and Fees request from the date the tax return was due. Hopefully, a glut of people who have been recently scammed will submit requests and get their money back.

These fucking scumbags scam non resident active duty military members trying to collect "income tax".

While I was stationed in California the Franchise Tax Board came after me for three years straight claiming that I owed them income tax. This was impossible as I wasn't a resident of California, paid Colorado income tax and my only source of income was the US Navy.

They just took my name and attributed a random amount of money I owed without ever stating the amount of "taxable income" I supposedly earned under their jurisdiction.

I hope that the state government collapses and all these paper pushing faggots get cancer & end up living under an overpass. Fucking disgusting humans.

My old man had an issue with the FTB a few years back as well. Don't recall all the details but it had to do with paying quarterlies where you'd have a few quarters around the same amount of income, then a big job got finished with a client that you have on net-30, and they'd fine you for non payment on sales tax even though the client hadn't paid up. I can get better specifics tomorrow since there was more to it.

I'd love to hear more specifics. If its a sales tax issue, it would have been the BOE (prior to 2018) or the CDTFA (2018 and on), but several people have told me the sales tax agencies run similar schemes to the FTBs.

I used to work in several states per year. For state income taxes, each state gets its share based on how much of the year I spent there. Except California. California (FTB) said ‘fuck that, we consider you lived here for the whole year,’ and took way more than they deserved, in effect double-billing me because I paid to all the other states.

I looked into a class-action suit. Unfortunately, a "class" means that each and every person was harmed in an identical way, so instead of 100 identical lawsuits, you have one where the identical thing happened 100 times. Taxes are almost never identical situations since each family's income, deductions, withholdings, estimated payments and so forth are rarely identical.

Hmmmmmm, this sounds suspiciously the same as what my State has done.

Taxes were paid, but for a few years I never bother filing, lo' and behold they said I owe $40K, but if I file, then the amount goes down.

The State filed papers stating that the money is owed, but there never was any collection activity, which makes me even more suspicious on the entire notion.

They did this one year at the Federal level during Obama Admin. Lots of folks were getting their estimated tax payments returned. At the same time, they were showing Congress that they had a cash flow problem and needed funds. It was the weirdest thing. So, folks had to cash the check they got and send a new check or transfer back to Treasury.

Fortunately, Tom Fitton took care of that for 2020 with a lawsuit forcing the counties to purge their voter rolls. But then the state responded by having the DMV "accidentally" register everyone to vote, whether they qualified or not. As far as I know, those false registrations weren't purged.

For mail in ballots, a huge percentage are thrown away due to "not matching signatures." This is determined by people who are not handwriting experts. Remember that the envelope of the ballot has your party affiliation by the bar code. This is just the tip of the iceberg with voting irregularity schemes.

Yeah... Last week I read a tweet that said when she went to her Polling place to go and Vote for DeAnna for congress right. But when she got there they said that she already voted... So what happened as she explained further is that vote was thrown out and she was allowed to Vote again it seems. This is a fraud scam on a whole new level!

You ask for a ballot simply by giving a name and address, no ID allowed. I am sure there are a lot of people with lists of names/addresses running around filling out ballots on behalf other people. It's very kind of them to take care of it for you, isn't it?

So knowing that she got the fraudulent ballot tossed makes me wonder... how many of these random voters come in after the real voter and have the real ballot tossed out and replaced with their fake ballot? All we know is whether our vote was counted, not if the ballot was replaced.

Good luck. In Florida state system, payroll is deposited into a "company account" instead of being delivered to the payees (employees) for two weeks. So, there is a two week delay in getting the money you are owed after you do the work. That money, all of the state pay money, sits in a magic account. So, they have have a rolling input-output with a two week delay for the whole pay system. Somebody is making a huge skim on that . Nobody cares or bats an eye.

I had a parallel situation with my bank. They held a deposit from clearing. I had 15 charges on my debit card - the largest was for $400. The rest were incidentals under $10. All where charged on the same day.

The bank applied the $400 charge first - intentionally. This caused my account to be overdrawn by $8.

They then put through the next 14 charges - and charged me a $32 overdraft fee for each charge.

I went into the bank to complain and they explained that they intentionally run the biggest charge first because they want to make sure people's mortgages get paid first.

Total bullshit.

If they would have applied the small charges first there would have been 1 overdraft fee.

I threatened to sue them and go to the press and they refunded all the overdraft fees.

IRS does the same thing to maximize late fees and penalties.
