It should be clear now the real reason they say this. They want to lead the public away from what our judicial system has been traditionally about; that a man is innocent until found guilty beyond a reasonable doubt.
Think about it, what better way would there be to silence dissenters than to be able to convict them unjustly of a crime and lock them away in prison? It makes a lot of sense. Franklin, and the rest of the founders, knew this, which is why they wrote the constitution the way they did.
