I believe the govt. already has that power. Under the patriot act (thanks, Bush) pretty much all of our rights are suspended in a national emergency. BTW, we,ve been in a state of national emergency since 9/11. Wait, it gets better: Obama tweaked the NDAA when it came up for renewal under his admin. that this unconstitutional power could be used EVEN if there isn't a national emergency. Some in the media questioned him on this, and he said he prob wouldn't sign it. In the eleventh hour, while we slept, HE DID.
