They need to decide if they are

  1. A platform and a legally open forum where they are not held liable for users posts.

or

  1. A publisher that actively moderates and censors while being legally accountable for what they put on their site.

The problem is when they are playing offense they act like a publisher but when they are playing defense, they act like they are an open forum. They shouldn't be able to have it both ways.

In reality, they fit the legal description of a telephone exchange.

We had this problem (censorship) with local, private telephone exchanges.

Laws are in place to protect us, we just need some Attorney Generals to declare them to be a telephone exchange.

The FCC needs to declare they are a publisher and treat them as such.

The FCC needs to declare they are a public forum* and treat them as such. The publisher thing is a lame cop out that won't fix the problem and in fact could and probably would lead to sites like this being sued.

I honestly don't care which way they go, as long as they pick one and stop letting them skirt the laws of both.

However, opening your "business" to the public, ostensibly "for free" is quite clearly opening a public service/forum, with the end goal of profiting by marketing to that user base. At the most basic of levels, a social media platform (they even call themselves platforms, making a court case a slam dunk in any reasonable world) is simply offering a communications platform.

We already have laws that govern communications platforms, and we already have laws that differentiate between private communications (phones, mail, and email) and open public communications (radio, television).

There is absolutely nothing about facebook or twitter that qualifies as a 'publisher' in any conceptual way. A publisher produces hand picked content for the express purpose of print or broadcast... over a communications platform.

There should have been laws against selling personal information (the real business), regardless of uninformed, improperly explained, unenforceable 'consent' by button press, a long LONG time ago. But that really is a different fight altogether.

If they are ever classified as a publisher, for some stupid reason, I'd still be happy with that. We can all sue them for publishing our work without due compensation.

Youtube is a different story. Youtube allows monitization and compensation for content creators. This DOES make them a publisher. Since they are the SOLE publisher on their own platform, Youtube should be the target of an anti-trust lawsuit. They should allow other publishing companies, as well as other advertising agencies, access to their public platform. They have created a private monopoly by being both the sole owner of the communications platform, and the sole publisher on that platform.

Disney+ should be right up their with them. A publisher creating their own broadcasting medium so they can have exclusive publishing status. But hey, Netflix got away with turning a broadcast platform into a publishing platform, so they'd probably win that suit unless someone takes down netflix first.

Time and again we have watched these digital companies OPENLY circumvent century old monopoly laws without the slightest pushback from the people who are supposed to be enforcing those laws. It's one more reason to be pissed off at our failure of a government.

I completely understand what you're saying but I'd much rather Youtube, Twitter, Facebook, Reddit get ruled a public forum like they should be and all the censorship against legal speech and favoritism has to go away.

Either way, seems like it should be one way or the other legally speaking, but I find the publisher designation won't fix anything as far as free speech is concerned and I fear would make them even more controlled against the right side of the political spectrum. These companies are essentially monopolies there's no real adequate competition when you look at the numbers.

It's upsetting that despite all the evidence, they are still able to weasle out of lawsuits, both from public and Congress.

Congress should just vote and have them regulated until they can prove they are an open platform.

Or just convince people to use something else and let twatter fail.

I suspect after Trump leaves office in 2024, Twitter, along with most of the MSM, will go bankrupt and fail.
