I'm not sure, I am not an attorney, but I would think the grocery store is private property and has the right to deny my entry??? So if I don't leave I guess its trespassing or something. Cops were very friendly and knew it was all BS, even mocked the directional arrows. Cops should just not be answering calls such as these.
You can say you can’t wear a mask for medical reasons. Under ADA and HIPPA they can’t question what your medical reason is. And if they still want to deny you entry, then they are discriminating against a person with a medical condition.
HIPPA applies to healthcare professionals- ADA doesn't prevent people from asking. But they have to take your word for it-- it's kind of like the support and therapy pet thing.
Did the cops say "we have to arrest you" or just "hey man, don't cause any trouble." Because those are two very different things. Asking honestly. Because (as is often posted on td.win), the cops will imply they have authority all the time... when they know in fact they have zero authority.
I was never threatned with arrest. Just the don't cause any trouble. Honestly, they were cool less actually showing up. I said can we shake hands after and they joked that grocery store would lose its shit if it saw on camera so we gave fist bumps and then I left the store few mins after.
Here's thing though, do they have authority? If a private property requires me to wear something, and I'm not, and they request I leave...idk?
Businesses are allowed to have a dress code for workers and customers. I can't decide that wearing a shirt is uncomfortable and go shopping shirtless. They will ask me to leave. If i refuse, they can call the cops. This works the same way.
Businesses want their customers to feel ensured that they are in a clean environment. Why customers feel unsafe with people not wearing masks? Media doesn't help. People actually think BREATHING can spread it. That's a whole other issue. I believe when the numbers are down and people start to feel safe, the laws will be allowed to expire or people will protest in larger numbers. We won't be as divided on the issue. Most people aren't wearing masks outside because they innately know it's pointless.
But right now, it's easier for stores to ask everyone to wear masks than track down the one person coughing is aisle 7 and clean whatever they may have coughed on.
