They wouldn't have killed him if he didn't try to take their shotgun.
He's a multiple time criminal, who just got caught committing a felony. Trespassing with intent to commit burglary is a felony in Georgia.
He chose an attempted murder instead of going to prison for an extended period of time. He got shot while both he and the younger McMichael were holding the shotgun. It's very likely he shot himself trying to wrench the gun away from its owner.
The McMichaels, one of which is retired law enforcement, were simply going to stop the man from further fleeing the crime scene until the police arrived. The police were already called by the time the McMichaels engaged in pursuit.
If they wanted to kill him, they would have just pulled up along side him and shot him without stopping the vehicle. It would be easy with that shotgun. Or, they could have just run him over in their full size pickup.
Instead, they chose to attempt to block the road. If they wanted to shoot him, they have already passed on several much easier and less dangerous opportunities before the deceased attempts to wrestle the gun away.
In my opinion, the first neighbor who called the cops should have just walked across the street with a shotgun and stopped him there, and then called the police. Would have saved everyone a lot of time and two innocent men wouldn't be in jail right now.
Same thing as Trayvon Martin case, he saw the men stopped in front of him, saw they were armed, but chose to attack, rather than flee or surrender.
He could have stopped, he could have ran off the into the side yards or woods, or turned back the opposite direction. would have saved his life, although he probably would have still been arrested.
And just like Zimmerman, the men in chasing him could have called it off, or made sure he never got close enough to them for him to even try to attack.
It might have been better for everyone if they would have not tried to force the confrontation by stopping the truck, but legally, they did not break the law, and he did break the law when he attacked them,
I am a staunch 2A defender, but they probavly did breakk the law. Most likely they will be determined to have brandished a weapon, which means any response from him was self defense. Remember, he didn't do anything violent or aggressive. We don't know if he was doing something wrong, but there is no evidence he was a deadly threat. A random person showing up with a gun and demanding you stop, while brandishing a gun, is easily interpretable as a threatening act.
This opinion is based on the video and evidence we have. I see a lot of speculation about a hammer earlier and such. They are still going to have to deal with chasing him down. This is a hard one to say the two guys didn't create the deadly situation. Even if the guy who was killed can't be completely absolved of some responsibility once all the facts are on the table.
