It has to be posted properly, which it rarely is on home construction sites. It's extremely common and they don't care, as long as you're not moving stuff or stealing. The company that built my house said "Your neighbors will go into the house during construction" in a 'don't get mad if they do' kinda way. Though, this kinda thing depends on the state, so, YMMV.
