Congress has to find you in contempt and refer the case to the US Attorney representing DC for prosecution. Coincidentally Barr's right hand man was just seated as the interim DC US attorney in January.

Timothy Shea (interim DC US Attorney) is solely responsible for Flynn's case being dropped. I think he's one of the good ones and will actually do some prosecuting.
