Outrageous is correct. I cannot wait to see Sydney Powell's response to this. She's already pulled up miles of swamp drain clog, and now this cuck is challenging her with this? She's gonna unleash fire and fury.

I am impressed with the bravery of this woman. I am surprised she hasn't committed suicide yet and zipped herself up in a duffle bag.

She may want to think about hiring security seriously.

28
Emper 28 points ago +29 / -1

She is probably safe as long as this is the most high profile case in the country. Couldn't imagine if the defense attorney was murdered during the trial how that would help their case. Afterwards maybe be another story.

This is insane. I can't find any sort of precedent or statute he's basing this power on, and no one's been able to point to one yet. Even legal forums seem to be stumped at the moment as to if this is even...legal.

This judge needs to be immediately removed from the bench and placed in solitary confinement in prison, with no lawyer, no visitors and maybe an occasional bat and pail of water for food.

What do you call it when you have an impartial judge who goes so far as to hire someone specifically to incriminate a person being tried in his court? The judge has just shown his extreme bias, and that in light of the fact that the plaintiff already dropped the case completely because the defendant was framed!

What is this "judge" doing? If there is any oversight whatsoever to our court system they should be all over this guy by tomorrow morning.

33
Long_time_lurker [S] 33 points ago +33 / -0

What is this "judge" doing?

Putting his finger on the scale. Gee, I really can't understand why the DoJ higher ups would want to pull the plug on an investigation after discovering that it was never warranted, or that the confession was improperly coerced with an illegal side deal using conflicted counsel.

This is the same guy that called Flynn a "traitor" in open court. Expect him to get bitchslapped on appeal, though if we get another leftist, it might take more than one appeal.

20

Did you see Victoria Toensing's comment, 2nd comment quoted in Conser. Treehouse? She is a fantastic attorney in her own right, but also the law partner and wife of Joe DiGenova. Here is what she had to say about it:

"Does Judge Sullivan read SupCt decisions? Last week SupCt held using amici was “drastic departure” and “abuse of discretion.” Why amici for @GenFlynn now when Judge refused Flynn friends amici 24 times. Judge shld be removed from case…then from Bench." #obamagate #maga

IDK navigating my way around that site is not easy! But I do not see anything where it says, right on that page anyway, that the amici was “drastic departure” and “abuse of discretion," that Toensing cites.

5
Long_time_lurker [S] 5 points ago +5 / -0

They linked to a PDF with the ruling:

It discusses a court's improper use of amicus briefing in more detail.

3
MW23232 3 points ago +3 / -0

Thank you, I wanted to see what the reasoning was!

45
DebunkTheLeft 45 points ago +45 / -0

If this so called "judge" is hiring a retired judge to actually try the case, this is prima facie evidence that Sullivan has deemed himself unqualified to preside over the case in the first place.

10
pmurTJdlanoD 10 points ago +11 / -1

He's gotta go home and tend to his wife's bull, prima faciel

37
Long_time_lurker [S] 37 points ago +37 / -0

So, the judge says this reeks of political interference... Yeah, they caught a corrupt prosecutor who made an illegal side deal and kicked him out and then dropped the case because it's clearly a mistrial at this point.

The fact that he's asking to show cause only for trying Flynn for perjury, especially this long after the fact, is telling as to how biased this is.

Also, the guy he just appointed so happened to have just penned an Op Ed against Flynn. I hope that Syndey Powell will move to recuse him on this basis as he's not really "independent."

This is Sullivan scrambling to put his fingers on the scale, but I don't think it will last more than a headline's worth. This will get overturned for abuse of discretion, I should think, if not on appeal than on the appeal after that.

leftistMediaFakeNews 14 points ago +14 / -0

Judge Sullivan is requesting retired judge John Gleeson to file an amicus brief outlining why: (a) the charge against Flynn should not be dropped; and (b) frame the argument about how to prosecute Flynn for perjury.

Now the purpose of the leaked conference call, aka instructions, from former President Barack Obama come into play; especially considering that Obama specifically mentioned “perjury” which is now part of what Judge Sullivan is attempting to accomplish.

It's not about charging Flynn with perjury, but with Contempt of Court for "lying" to the court about lying to the FBI.

I honestly don't know how this whole thing shakes out. I mean, it almost seems as though judges have an uncontested and near limitless power in pursuing such charges (contempt charges that is).

To be fair, it was obvious to everyone, including yours truly, that perjury was the last thing they had left they could go after. I strongly disagree with it, of course, but I at least see how they came up with it.

What they're doing now is completely out of left field. Expect Flynn's lawyer to seek something called a Writ of Mandamus asking a higher court to say, in essence, "WTF, stop that you idiot" to Sullivan.

10
deleted 10 points ago +10 / -0
10
JustanotherTXPede 10 points ago +10 / -0

Attorney here (former US circuit court of appeals judicial law clerk). Judge Sullivan has jumped the shark. This cries out for a petition for a writ of mandamus to Judge Sullivan's supervising court, that is, the DC Circuit Court of Appeals. A writ of mandamus is an instruction from the supervisory court that the judge must do his job. In this circumstance, there is binding case law of the DC Circuit stating that when the prosecution and defense agree that the case should be closed, the district judge must close the case. So Judge Sullivan is violating binding law on his court in his refusal to dismiss the Flynn case.

A writ of mandamus, followed by an investigation for judicial misconduct based on Judge Sullivan's apparent improper ex parte contact with the retired judge, would be a fitting end to this travesty of justice.

3
Long_time_lurker [S] 3 points ago +3 / -0

Do you have a cite for the binding case law? I'd love to read up on it.

EDIT: I assume you're referring to US v. Fokker?

Get involved in politics, or politics will get involved in you. If this doesn't wake you up to get involved in politics at any level, then you're just food for predators.

Need some oppo research on this judge STAT. The fact that Gillum was having meth filled gay orgies without us knowing shows how weak our side is on digging dirt.

What is this? Moot court?

We are dealing with somebody's freedom here. His rights have been violated. The act accused pled to cannot be proved by existing evidence on record. Prosecutorial misconduct has been established. Prosecution refuses to prosecute. This judge is violating the accused's right to a speedy trial.

It's too late for the swamp. They are finished now....after the next couple weeks it's all over for them!

This judge belongs in jail.

Even worse the other Judge recruited by the Flynn judge had written a op-ed saying he would find Flynn guilty.

On top of that judges in the USA do not have the power to prosecute a case. This judge is claiming a power that is not available to him. If it is not struck down on an appeal then I would be surprised.

I am incredibly surprised by the Deep State taking it this far. They must have some truly terrible secrets to hide.

Exactly. They should file a motion to recuse him and a motion for a writ of mandamus to have a higher court order an end to this nonsense.

So the prosecution drops out and the judge decides to appoint a different prosecutor? Is that how this works?

No, this is running off the rails and is absurd. The judge is abusing his discretion at this point.

Sounds like obstruction of justice to me. This reflects very poorly on Justice Roberts and the judicial branch. If judges don't want to end up like the FBI, they need to reign in this rouge judge.

I hope that Syndney gets a Writ of Mandamus judicially bitchslapping Sullivan for this nonsense.

He has good reason to clean house after this mess, but he should be looking at the former prosecutor's lies and the coerced confession, not trying to finish the setup against Flynn.

Then again... I sort of think he was part of it. I don't think Sullivan "accidentally" tapped an amicus who just penned an op ed judging Flynn. I just wonder how far back it goes.

I call on all autists to look for any and every possibly improper ex parte contact that Sullivan has had recently with these "Watergate Prosecutors", this unfriendly amicus, and anyone that's recently been fired from the DoJ that can show bias or collusion.

Scour their social media, online photos, etc.!

Except.. You can't be charged with perjury for accepting a plea bargain even tho you're innocent.

Sullivan basically questioned Flynn in court about the plea he was accepting. The problem is that the whole thing happened under duress. Flynn was facing overwhelming evidence because it was his word against the FBI's and the FBI had only a summary of their talk, written months later (and marked "draft"...) by the same agents who it was later proven conspired to violate his rights.

He should have entered his plea as one of pleading guilty due to overwhelming evidence, but he was advised by conflicted counsel (who could also have been subject to the FARA violations Strzok & co. were working on).

So he's been set up and didn't know he had any way to prove his innocence until later. I have a hard time faulting him for that, especially when the court is giving a free pass to Van de Cuck as I now call the corrupt prosecutor and everyone else who conspired to violate Flynn's rights in court.

We need to turn this to our advantage.

Continue digging and releasing findings facts damaging to the former Flynn prosecution team, the politicians who unmasked him and illegally leaked, the people who framed him, and the Russia narrative in general.

The longer they keep it an active issue the more it should be dug up to the roots.
