Sullivan is trying to try the case now the prosecutors have admitted it's a made up hoax. That's not the role of the judge. He's there to interpret the law and make rulings on matters of law. What he is doing will be overturned 100%. Flynn's lawyers should immediately appeal.

Right now, he'll probably seek a writ of mandamus, i.e. ask a higher court to tell Sullivan to cut this nonsense out and direct Sullivan to dismiss. The main problem is that there was a good reason to keep this open--to address the prosecutorial misconduct that happened right under this judge's nose.

Alas, appointing an "amicus" to try Flynn for perjury when that guy has just the other day penned an op-ed prejuding Flynn is... not even remotely reasonable.

If Sullivan does get away with some nonsense before a higher court puts a stop to it, expect to wait for months of appeals until it finally gets thrown out.

Essentially Flynn could request the trial be moved to a different district e.g. change of venue because of obvious prejudice. There's no appeal until there's a verdict because without the verdict there's no "injury" to appeal

I think even the left sees that an absolute can of worms this could open if judges are allowed to bring up charges and issues sua sponte. Most importantly, their judicial activism could be more easily undone if this was allowed to stand.

No judges are lord of their own domain, until they say they are done. Then the higher court can weigh in. And the liberal judges of the higher court can make a sudden complete reversal on amicus briefs.

If someone they force they trial to go forward and Flynn is convicted he can appeal and the Supreme court ruled strongly against judges inviting specific people/groups to submit amicus briefs and then basing their decision on those briefs.

In California the court invited a bunch of groups to submit amicus briefs because the activist clearly lost her case. These were all groups the judges were specifically inviting and had ties to. Then most of the case time was devoted to these briefs.

Sound similar?

Personally, I don't think it will get that far. How can you force prosecution to prosecute? Plus even the prior prosecution didn't want to face Flynn in court, hence why they threatened his family. They knew their case was flimsy as fuck.

Seems like the left has gone all in. In just the past couple days in seems like the culture war has come to a head - judicial, legislative and executive misconduct at all levels of government across the country.

I looked up Sullivan on Wiki. He was born in '47. There's another Clinton judge in that same district court that was born in '43. If Trump wins a second term, he might be able to bring some balance to that district. But it's loaded with Obama judges.

Yea, what OrangeElvis said... you need buy in from both sides. Sounds like it would be the same as impeaching the president. The House brings the charges (plays the part of the prosecution) and the Senate makes the ruling (plays the part of the jury).
