Cuomo said COVID would kill people, then intentionally sent COVID positive patients to nursing homes. That's not negligence.

Criminally negligent homicide is what it is

He said COVID kills, then intentionally inflicted COVID on a population. To me, this shows intent to kill. Add the fact that he did it to more than one person, and that's murder in the first degree in NY. NY CLS Penal § 125.27

Yes, his defense will be that he did not intend to kill them. But he said on April 8 "Let's expose something that you've been lied to about for too long: this 'but the swine flu' B.S.," said Cuomo. "It took a year for that virus in 2009 to claim the amount of lives we've lost in less than two months. Do you understand that now? Do you understand that how quickly something can kill you has a direct relationship to how deadly that thing is? Stop ignoring the facts for political advantage. Get real, the past is over."

Something that can kill you quickly. And then, on April 23, he's still saying nursing homes can't reject COVID positive patients. (https://nypost.com/2020/04/23/nursing-homes-cant-reject-coronavirus-patients-cuomo-says/)

So yes, seems like a pretty good argument for intent.

Look, normally I would not be about prosecuting over medical decisions. Humans have little control over a disease. If you know, though, that it's deadly, and then don't do everything possible to keep people under your control out of harm's way (as opposed to adults making this choice on their own), especially when facilities had been provided specifically for that purpose, then it seems the intent was to kill people to further his political agenda. That's murder.

It's called man slaughter James.... Just because he didn't mean to, doesn't give him the right to walk away from killing literally thousands

He did mean to, though.

I hear you. It sure looks like a conspiracy when you have all these blue states making the same deadly decision

If the rules had simply said, "try to readmit patients whenever possible and you don't think they have the virus," and some slipped through, that would be one thing. Or, if you (reasonably) didn't think the virus was bad, and said "we're not rejecting patients for a cold." The argument there would be negligence, if anything.

That's not what happened. What happened was, they said "This virus kills everyone," and "You must admit COVID-positive patients." I mean, these same people are the ones implementing lock downs and school closures among a populace that is nearly immune, arguing that the disease is that bad. So, that's murder. And it happened in tons of blue states.
