I think that's the plan to be honest. Not Flynn's plan but the Deepstate.

Because Flynn has already been proven innocent under the letter of the law. Deepstate can't win legally. So their only tactic is optics now.

So I think their plan is to do such a miscarriage of justice, force it to the Supreme Court, where the court will of course side with the law...but this will allow the media to paint it as "Trump's handpicked judges let Flynn go, Trump is corrupt!"

As I understand it, Flynn was coerced into pleading guilty a really long time ago, and the prosecution kept asking for a delay in sentencing. They delayed for so long, that Flynn got new defense in Sidney Powell, who convinced him to try and withdraw his plea deal. At the same time, Durham uncovered evidence showing foul play in the prosecution of Flynn, and as a result, the DOJ has dropped the case against him.

However, since Flynn already pled guilty, the Judge is now saying that he has the right to keep the trial going, and that if he decides not to allow Flynn to withdraw the guilty plea, then he can sentence him for the crime he pled guilty to, regardless of the fact that it was a coerced deal, and that the DOJ has withdrawn the case, ie. no longer claim Flynn is guilty of what he pled to.

It’s sick, and it will never hold up to constitutional challenge.

A guilty plea in court is really meaningless. People always plea based on their chances of winning and the cost of winning. It has nothing to do with with if someone is guilty or innocent.

There should be a third plea, no contest.

It is meaningless. It just signals to the court whether you intend to fight and whether or not the prosecution has to bother with the burden to prove a crime was committed.

But its also (illegally) used by judges to determine how much they want to punish someone, for the trouble. So if you plead not guilty but are guilty, they can hit you hard in sentencing....which is ridiculous, because it's always the burden of the prosecution to prove a crime was committed, and a person may be able to waive that for expediency, but it can't exactly be taken away entirely, otherwise that's the same as disallowing a person to have the right of being innocent until proven guilty.

The wording is innocent until PROVEN guilty. Not innocent until they say they are guilty. Of course you could say that a defendants own admittance of guilt is proof, and that's fine, but if they withdraw that admittance of guilt, then that's no different than having bad evidence, which wouldn't matter, because if the prosecution has other evidence of a crime than a guilty plea, they should just prosecute as normal, because the burden is still on them to prove guilt.

In a sick way, the only reasonable purpose of how it is now, is to entrap people that the prosecution may not have the goods on to truly prove guilt, to use it to scare them into a guilty plea.

A guilty plea should be able to be withdrawn at any time with NO kind of punishment. That might lead to some extra fuckery in the courts from defendants, but if prosecution has proven their case in a court, changing a plea to not guilty won't functionally change a thing about how the judicial system operates (or rather, should operate).

It's more like a move in game based on the goal of best net gain. If Flynn lied it was a white lie and stuff the FBI shouldn't have known or had their noses in. He actually did the best thing in that sense in forcing them to reveal their ill gotten hand.

Punishment for changing plea is unheard of in my books when the conditions change. If you're innocent but either the cost of pleading guilty is less than proving innocence or you believe a guilty verdict is inevitable then you plead guilty to reduce the harm inflicted by a wrong verdict.

Given exculpatory evidence was suppressed putting Flynn even more in the position of being at the mercy of the prosecution then go figure.

Neither do we, the judge has gone completely off the rails here.

The basic answer is that he didn't like that the DoJ dropped the prosecution due to prosecutorial misconduct, so he appointed his own prosecutor under the guise of an "amicus" to take over the state's role. Said "amicus" has already publicly declared Flynn guilty in an op-ed in a major paper. The court, as well, has called Flynn a "traitor" in open court, something in no way supported by any of the accusations against him.

He should absolutely be censured for abuse of discretion when they decide on this writ, but only in a just world if we draw a just judge to review this instead of someone biased.

Sullivan is using the “phone a friend” clause of the Constitution. It’s in the addendum, so not many people read that far.

If that fails, he has one last attempt. It’s the “No Whammy’s” gambit. They bring in the board from the game show and Flynn has one attempt to get “No Whammy’s.” If he does, he has to go to jail.

Amen. The only thing that makes me sad is that Susan Rice's CYA memo came out a day too late to be included here, it only makes the setup that much more obvious.

That said, the mandamus petition was everything I wanted and expected to read. I can't see a single missing beat here. In a just world, this would end with an order censuring Sullivan and dismissing the case.

Frankly I want to start a group after the Fokker ruling that points out that this use of "amicus curae" is nonsense, talk about our strong interest in stopping judicial misconduct and submit an amicus brief calling him a dirty Fokker.

But he'll just ignore all amicus briefs but those which support his narrative and they won't even get docketed because he'll find whatever obscure local rule he has to in order to claim that nobody who says things he doesn't want to hear have any right to be heard, but all his amici will be able to present whatever TDS drivel they want to the court for investigation.

I have a feeling this setup happened some time ago. How long has this amicus of his been working with Mueller prosecutors? He probably figures--and may even be right--that the worst he faces is a strongly worded letter given that he can't be too many years away from retirement at his age. In a just world, we'd impeach him for this egregious misconduct and abuse of discretion.

A writ of mandamus against a judge is very rare. It's only used when he's clearly doing something extremely far outside what is right and normal.

The scheduling order doesn't mean much. He will put it on hold if the Appeals Court acts, which it very likely will. And since it was an emergency motion, they should be acting pretty quick. They'll probably order briefing in the next day or two.

They did. Judge Sullivan here, who has shown in the past he's not a complete moron, has decided in a completely unprecedented move to ask for amicus briefs to be filled and has appointed a partisan retired judge to essentially continue the prosecution.

It's odd because Sullivan is one of the central figures in Flynn's attorney Sidney Powell's book liscence to lie, which is about previous malfiesence in the DOJ by none other than Mueller report author Andrew Weissman and others.

Maybe he has a deep state boot on his neck. That's what I think anytime I see "record conservative judges." It's very, very hard to get Congress to legislate, but it's very, very easy to bribe and/or extort a singular human judge.

It's an interesting thought that maybe Sullivan decided to commit such an egregious move in order to make sure it would be instantly overturned, while sending a message to the legal community that he's under a gun. "See? I did what you told me to, I kept things going, but dagnabbit, that appeals court stepped in!"

It's up to the judge sitting on the case whether or not to pursue, even if the plaintiff (in this case, the DOJ) drops the charges. Like 9000% of the time if the plaintiff drops the judge will dismiss, but this is a dirty assed judge that needs to be disbarred.

The closest precedent is for situations like when a woman tries to drop charges against an abusive husband/boyfriend, and the state decides to prosecute anyways. Except even in this case, the state, i.e. the federal government, has dropped the charges. Sullivan will lose in the end, but he's going to try every dirty trick he can to extend Flynn's suffering. This isn't about justice, it's about spite, it always was.

What makes it even more egregious is the fact that with all the information recently released about how the FBI agents were operating, even if they could try to prosecute the case, they would never win. The judge doesn't care about this information, because he's in on it. He's playing the part he was meant to play long before Flynn got framed. Sullivan wasn't a random judge, he was chosen specifically because they knew he was corrupt.

I think this is the actual situation. This is why people don't report crimes in some cases because they'd rather not involve the police and all the issues/disruption in life that can cause for them personally or those around them.

I think the deep state scumbags want Trump to pardon Flynn, rather than him getting a complete dismissal. This would make it more difficult for Trump to bring Flynn back into a position in the IC. Just my opinion

I feel this was the plan all along by judge Sullivan. Drag things out until the upper court is forced to take it. When the charges are dropped, the Left can change the narrative to “Flynn is guilty but the corrupt, conservative judges overturned it as a favor to Trump. One of the judges is appointed by Trump so it must be true.”

This all goes back to the turn of the 20th century, a time in which corrupt democrat machines had achieved full control of the major cities and much of Washington. The icing on the cake was the arrival of the Sicilian Mafia and the administrations of FDR, who thoroughly and brazen politicized the judicial. When was the last time we heard of judicial misconduct, bribery, or conflict of interest? Those cases go nowhere, today.
