Better watch out, I hear they are gonna reboot it with Aziz Ansari as Yogurt, Chris Pratt as Lone Star, Billie Lourd as Vespa, Kevin Hart as Dark Helmet, and Jonah Hill as Barf.
It's just a sad fact of life people don't always show their true colours until they do such as murder cases where the murderer seemed perfectly normal until they weren't and no one expected it or could believe it.
Pretty sure his "amicus" is close to some of Mueller's team. Based on the "treason" comments, I'm pretty sure his head is deep up the ass of some cuck conspiracy theories like those on redacted.
Well that's pretty simple to answer.... ask yourself this, have you ever seen a judge indict someone and then prosecute them in a court of law by themselves?
I think that's the plan to be honest. Not Flynn's plan but the Deepstate.
Because Flynn has already been proven innocent under the letter of the law. Deepstate can't win legally. So their only tactic is optics now.
So I think their plan is to do such a miscarriage of justice, force it to the Supreme Court, where the court will of course side with the law...but this will allow the media to paint it as "Trump's handpicked judges let Flynn go, Trump is corrupt!"
As I understand it, Flynn was coerced into pleading guilty a really long time ago, and the prosecution kept asking for a delay in sentencing. They delayed for so long, that Flynn got new defense in Sidney Powell, who convinced him to try and withdraw his plea deal. At the same time, Durham uncovered evidence showing foul play in the prosecution of Flynn, and as a result, the DOJ has dropped the case against him.
However, since Flynn already pled guilty, the Judge is now saying that he has the right to keep the trial going, and that if he decides not to allow Flynn to withdraw the guilty plea, then he can sentence him for the crime he pled guilty to, regardless of the fact that it was a coerced deal, and that the DOJ has withdrawn the case, ie. no longer claim Flynn is guilty of what he pled to.
It’s sick, and it will never hold up to constitutional challenge.
A guilty plea in court is really meaningless. People always plea based on their chances of winning and the cost of winning. It has nothing to do with with if someone is guilty or innocent.
It is meaningless. It just signals to the court whether you intend to fight and whether or not the prosecution has to bother with the burden to prove a crime was committed.
But its also (illegally) used by judges to determine how much they want to punish someone, for the trouble. So if you plead not guilty but are guilty, they can hit you hard in sentencing....which is ridiculous, because it's always the burden of the prosecution to prove a crime was committed, and a person may be able to waive that for expediency, but it can't exactly be taken away entirely, otherwise that's the same as disallowing a person to have the right of being innocent until proven guilty.
The wording is innocent until PROVEN guilty. Not innocent until they say they are guilty. Of course you could say that a defendants own admittance of guilt is proof, and that's fine, but if they withdraw that admittance of guilt, then that's no different than having bad evidence, which wouldn't matter, because if the prosecution has other evidence of a crime than a guilty plea, they should just prosecute as normal, because the burden is still on them to prove guilt.
In a sick way, the only reasonable purpose of how it is now, is to entrap people that the prosecution may not have the goods on to truly prove guilt, to use it to scare them into a guilty plea.
A guilty plea should be able to be withdrawn at any time with NO kind of punishment. That might lead to some extra fuckery in the courts from defendants, but if prosecution has proven their case in a court, changing a plea to not guilty won't functionally change a thing about how the judicial system operates (or rather, should operate).
It's more like a move in game based on the goal of best net gain. If Flynn lied it was a white lie and stuff the FBI shouldn't have known or had their noses in. He actually did the best thing in that sense in forcing them to reveal their ill gotten hand.
Punishment for changing plea is unheard of in my books when the conditions change. If you're innocent but either the cost of pleading guilty is less than proving innocence or you believe a guilty verdict is inevitable then you plead guilty to reduce the harm inflicted by a wrong verdict.
Given exculpatory evidence was suppressed putting Flynn even more in the position of being at the mercy of the prosecution then go figure.
Neither do we, the judge has gone completely off the rails here.
The basic answer is that he didn't like that the DoJ dropped the prosecution due to prosecutorial misconduct, so he appointed his own prosecutor under the guise of an "amicus" to take over the state's role. Said "amicus" has already publicly declared Flynn guilty in an op-ed in a major paper. The court, as well, has called Flynn a "traitor" in open court, something in no way supported by any of the accusations against him.
He should absolutely be censured for abuse of discretion when they decide on this writ, but only in a just world if we draw a just judge to review this instead of someone biased.
Sullivan is using the “phone a friend” clause of the Constitution. It’s in the addendum, so not many people read that far.
If that fails, he has one last attempt. It’s the “No Whammy’s” gambit. They bring in the board from the game show and Flynn has one attempt to get “No Whammy’s.” If he does, he has to go to jail.
Amen. The only thing that makes me sad is that Susan Rice's CYA memo came out a day too late to be included here, it only makes the setup that much more obvious.
That said, the mandamus petition was everything I wanted and expected to read. I can't see a single missing beat here. In a just world, this would end with an order censuring Sullivan and dismissing the case.
I hear you, but we'll get a harshly worded rebuke from the appellate court if we're lucky :( The bad thing will be if we draw another biased judge and this has to go to the Supreme Court... they're already trying to impeach Trump over this.
Only in clown world is exposing their misconduct a crime.
I remember when Flynn was assigned Sullivan back when r/TheDonald sub was active. The lovefest for Sullivan was ripe. People were saying Sullivan was a based patriot judge.
I would guess the truth is probably a sad one. I’d guess he was a based judge and took on the government in the ted Stevens case and then they used their surveillance or dirty laundry tactics and found something on him that would make sure he never strayed again.
He was decent... in the past. Then he started calling Flynn a traitor in open court and all sorts of nonsense, like ignoring all the prosecutorial misconduct. Sydney quotes his own rulings to show how far out of whack he's gone due to the TDS.
In a just world, they'd throw him off the court and send him to prison for this nonsense.
Frankly I want to start a group after the Fokker ruling that points out that this use of "amicus curae" is nonsense, talk about our strong interest in stopping judicial misconduct and submit an amicus brief calling him a dirty Fokker.
But he'll just ignore all amicus briefs but those which support his narrative and they won't even get docketed because he'll find whatever obscure local rule he has to in order to claim that nobody who says things he doesn't want to hear have any right to be heard, but all his amici will be able to present whatever TDS drivel they want to the court for investigation.
I have a feeling this setup happened some time ago. How long has this amicus of his been working with Mueller prosecutors? He probably figures--and may even be right--that the worst he faces is a strongly worded letter given that he can't be too many years away from retirement at his age. In a just world, we'd impeach him for this egregious misconduct and abuse of discretion.
??Any lawyers here who can help me on this question:??
How is a charge of PERJURY being discussed in this set of circumstances? Surely, the judge can cite an individual for contempt of court. But can he bring NEW CHARGES? Wouldn't the DOJ have to file a new charge???
He mad it up. Article 7 allows due process to allow a defendant to change their plea. It’s not perjury because it’s a process right. He’s just a fucking asshole deep state fag.
It isn't. This is something he invented out of whole cloth. They hope to get Trump to pardon him and they've already said that they want to impeach Trump, again, over this.
So they're probably playing to the cameras right now. This has NO legal basis and anyone who says otherwise is scamming you. That said, there's no shortage of idiots who will make up some nonsense about what they think the law should be here and try to sell it. It's kind of what lawyers do.
It's completely unhinged and a manifestation of severe TDS.
A writ of mandamus against a judge is very rare. It's only used when he's clearly doing something extremely far outside what is right and normal.
The scheduling order doesn't mean much. He will put it on hold if the Appeals Court acts, which it very likely will. And since it was an emergency motion, they should be acting pretty quick. They'll probably order briefing in the next day or two.
There's no "legal" format, but there are style guides. Case citations are pretty universal. The most common style guide is called the Bluebook. Footnotes can be more free-form.
Nor was this the end of the matter. The district judge’s latest actions—failing to grant the Government’s Motion to Dismiss, appointing a biased and highly-political amicus who has expressed hostility and disdain towards the Justice Department’s decision to dismiss the prosecution, and the promiseto set a briefing schedule for widespread amicus participation in further proceedings—bespeaksa judge who is not only biased against Petitioner, but also revels in the notoriety he has created by failing to take the simple step of granting a motion he has no authority to deny. This is an umpire who has decided to steal public attention from the playersand focus it on himself. He wants to pitch, bat, run bases, and play shortstop. In truth, he is way out in left field.
or: "There is literally no case being argued here. There has been zero evidence presented, zero case presented, just a Plea Deal that is now gone. No case exists here. The Judge has gone rogue and must be replaced."
They did. Judge Sullivan here, who has shown in the past he's not a complete moron, has decided in a completely unprecedented move to ask for amicus briefs to be filled and has appointed a partisan retired judge to essentially continue the prosecution.
It's odd because Sullivan is one of the central figures in Flynn's attorney Sidney Powell's book liscence to lie, which is about previous malfiesence in the DOJ by none other than Mueller report author Andrew Weissman and others.
Maybe he has a deep state boot on his neck. That's what I think anytime I see "record conservative judges." It's very, very hard to get Congress to legislate, but it's very, very easy to bribe and/or extort a singular human judge.
It's an interesting thought that maybe Sullivan decided to commit such an egregious move in order to make sure it would be instantly overturned, while sending a message to the legal community that he's under a gun. "See? I did what you told me to, I kept things going, but dagnabbit, that appeals court stepped in!"
It's up to the judge sitting on the case whether or not to pursue, even if the plaintiff (in this case, the DOJ) drops the charges. Like 9000% of the time if the plaintiff drops the judge will dismiss, but this is a dirty assed judge that needs to be disbarred.
The closest precedent is for situations like when a woman tries to drop charges against an abusive husband/boyfriend, and the state decides to prosecute anyways. Except even in this case, the state, i.e. the federal government, has dropped the charges. Sullivan will lose in the end, but he's going to try every dirty trick he can to extend Flynn's suffering. This isn't about justice, it's about spite, it always was.
What makes it even more egregious is the fact that with all the information recently released about how the FBI agents were operating, even if they could try to prosecute the case, they would never win. The judge doesn't care about this information, because he's in on it. He's playing the part he was meant to play long before Flynn got framed. Sullivan wasn't a random judge, he was chosen specifically because they knew he was corrupt.
I think this is the actual situation. This is why people don't report crimes in some cases because they'd rather not involve the police and all the issues/disruption in life that can cause for them personally or those around them.
I think the deep state scumbags want Trump to pardon Flynn, rather than him getting a complete dismissal. This would make it more difficult for Trump to bring Flynn back into a position in the IC. Just my opinion
Bout time. Was wondering where the check and balance was on the Judiciary. Do they not report up to the Supreme Court? Individual judges wield far too much power.
I feel this was the plan all along by judge Sullivan. Drag things out until the upper court is forced to take it. When the charges are dropped, the Left can change the narrative to “Flynn is guilty but the corrupt, conservative judges overturned it as a favor to Trump. One of the judges is appointed by Trump so it must be true.”
The judge: he’s guilty
The government: we don’t actually have any evidence he lied.
The judge: still guilty
The government: he was never actually under investigation
The judge: still guilty
The government: and we lost the 302’s that proved he was innocent
The judge: still guilty
The government: so we’re dropping the charges
The judge: still guilty
The government: guilty of what?
The judge: I don’t know yet. I’ll have to consult with a bunch of people who hate his guts for their opinions
This is an umpire who has decided to steal public attention from the players and focus it on himself. He wants to pitch, bat, run bases, and play shortstop. In truth, he is way out in left field.
This all goes back to the turn of the 20th century, a time in which corrupt democrat machines had achieved full control of the major cities and much of Washington.
The icing on the cake was the arrival of the Sicilian Mafia and the administrations of FDR, who thoroughly and brazen politicized the judicial. When was the last time we heard of judicial misconduct, bribery, or conflict of interest? Those cases go nowhere, today.
Hell yeah, get these commie bastards smacked down!

No. There is no precedence for this.
Judges are not of the Dredd variety. If there is no one bringing a criminal complaint then there is nothing to adjudicate.
It is not an exaggeration to suggest that this judge is acting completely outside of his authority.
It 100% is. SCOTUS even in current form would likely rule 9-0 that it's an abuse of separation of powers.
It's just a sad fact of life people don't always show their true colours until they do such as murder cases where the murderer seemed perfectly normal until they weren't and no one expected it or could believe it.
Where or what is the dirt on Sullivan?
Someone has their heavy thumb on Sullivan's scale of fair justice, IMHO.
he got his son rape and beating charges dismissed
Pretty sure his "amicus" is close to some of Mueller's team. Based on the "treason" comments, I'm pretty sure his head is deep up the ass of some cuck conspiracy theories like those on redacted.
What he's doing he clearly been deemed illegal, they should consider this a "crime in progress" with the perpetrator being the judge.
Well that's pretty simple to answer.... ask yourself this, have you ever seen a judge indict someone and then prosecute them in a court of law by themselves?
No? Ok then.
Law firm of TAR AND FEATHER
I've been saying this should come back in style...
Does that law firm have offices in Texas, Arkansas or Alabama?
I think that's the plan to be honest. Not Flynn's plan but the Deepstate.
Because Flynn has already been proven innocent under the letter of the law. Deepstate can't win legally. So their only tactic is optics now.

Exactly! Do you really care if you piss off the hornet that is already trying to sting you!?!?
Precisely!
And what's to stop Judge Sullivan from just ignoring that ruling if it's in favor of Flynn?
Some people will only be stopped if the door to their office gets locked and a police officer strongarms them back to their car.
An army kekistani keyboard warriors?
That's impeachment. Incredibly rare and difficult to do, but a District Judge ignoring a ruling from a Court of Appeals? Out he goes.
By a Democrat controlled House...? Never going to happen.
They've already told the Supreme Court that they're planning to impeach Trump for this. Again.
So much TDS.

How To Remove A Federal Judge

REEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEE!

Sullivan needs to be walked out in handcuffs. He has zero regard for the law and acts like a little tyrant.
I like the cut of your jib.
Sopranos!
Walking is for winners. This piece of Schiff deserves to be drug out.
Yes. Bit crazy since the judge is not the one with prosecutorial digression, no?
Furthermore, the judge went out of his way to submit more testimony.
Furthermore he called in a friend to do that who JUST RECENTLY penned an OP-ed against Flynn.
Furthermore, the supreme court JUST LAST WEEK ruled that americus briefs like this cannot be used except to help the defendant.
And let's not forget the entire mess that was this case
This judge needs to hang with the rest of them.
As I understand it, Flynn was coerced into pleading guilty a really long time ago, and the prosecution kept asking for a delay in sentencing. A guilty plea in court is really meaningless. People always plea based on their chances of winning and the cost of winning. It has nothing to do with with if someone is guilty or innocent.
There should be a third plea, no contest.
True. We got weirdos trying to take credits for murders out there and plead guilty but doesnt mean they are or will be sentenced for it.

That’s nice to hear from an attorney. My lay-person read was similar and I’m very proud of Sidney and Mike.
And inside baseball that you found particularly shocking? How often do you see writs of mandamus?
Edit: also Sullivan just scheduled oral arguments for all of this amicus brief bullshit for July 16. How does that affect the writ of mandamus?

So that they can run a second impeachment trial during the elections

The filing is in this
Bout time. Was wondering where the check and balance was on the Judiciary. Do they not report up to the Supreme Court? Individual judges wield far too much power.
Sydney Powell had to file this suite with zero help from D.O.J. who should have joined her in this fight.
D.O.J is just as corrupt now as before. still swamp
Are there many trump appointees in that circuit?
There are two Trump judges with one more waiting a senate vote, but the court is split 7-5 for dems.
Breaking: Hawaiian judge rules Russiagate is real and Judge Sullivan is the real AG
No doubt in my mind its happening!
It is only Tuesday folks :)
Either way shit will hit the fan, which since corona has made half of our country idiots; I invite wholeheartedly
The judge: he’s guilty The government: we don’t actually have any evidence he lied. The judge: still guilty The government: he was never actually under investigation The judge: still guilty The government: and we lost the 302’s that proved he was innocent The judge: still guilty The government: so we’re dropping the charges The judge: still guilty The government: guilty of what? The judge: I don’t know yet. I’ll have to consult with a bunch of people who hate his guts for their opinions
Justice.
it won't do anything, but it does get her grounds to overturn on appeal.
My favorite line from the Writ of Mandamus:
(Referring to Judge Sullivan)
WHO’s on first?
I keep on asking myself when General Flynn is going to round up some war buddies and ride on DC.
A surprise to be sure, but a welcome one.
Get them Flynn, we know the truth. Time to kick these piles of (-hu)man trash from their lifelong seats of absolute corrupted power.
44 pages of “fuck you, Emmett “
*anxiously stirs pot of tar and fluffs pile of feathers....
If this fails the Republic is dead, the judiciary have already become clergy to progressive dogma
Those cases go nowhere, today.
yes.... Yes.... YES!!
It would be really nice if the GOP could win the House, make big gains in the Senate and then impeach the judge....and a few more while we're at it.
In the 80s, just the Kavanaugh debacle would have been enough to guarantee that, but it was a different country back then.
Filing this petition before Sullivan could get his buddy to influence the outcome seems like good tactics.
Something tells me if Flynn was black Sullivan would’ve dismissed the case.
SOmething tells me if Flynn was a Pot bellied Goblin Democrat he would of dismissed the case.
Flynn would get a double secret conviction if he were a gay frog.
