Read Sidney Powell's Licensed to Lie. Sullivan is basically the hero. He not only threw out the Ted Stevens case - a case which cost an honest Senator his reelection - he appointed a special investigator who exposed the DOJ as having fabricated the crime it accused Stevens of committing.

What happened between then and 2017? I think someone at DOJ dug up something on him so that he wouldn't do that to them again.

He was legit from what I ever heard about him . . . till he suddenly wasn't. Whatever happened - or whenever he was allegedly made to flip it seems - possibly occurred very recently, within past 6 months, when he verbally attacked Flynn and Powell in open Court. Weird. He was the "hero" figure in her book, too, "Licensed to Lie", abt the Sen.Ted Stevens case. SMH. He just is not the guy anyone would have thought . . . from what little I knew abt him anyway.

He used to be a great, respected Judge. He was the "hero" of Sidney Powell's book, "Licensed to Lie", which was about the Alaska Sen. Ted Stevens case/set-up, which Judge Sullivan presided over! I was happy when Sullivan took Judge Contreras' (remember him???) place as Flynn's Judge, till he apparently . . . well something happened to him, seemingly around this past December.

It's subtle, but that's pretty important. They're calling him out on two major precedents that say he can't do what he just did, as well.

He's been ordered to reply to this petition directly and NOT via his amicus. Some leftist Twitterati are complaining about the judges drawn. Advantage is on our side, for now.

I suppose, in theory, he could dump the whole thing and reply to the appellate court that their intervention was now moot due to that, but I just don't feel it. He's going to have to put all his cards on the table in the next 10 days.

He can't. In this same case he earlier entered an order prohibiting anyone from filling an amicus brief, explaining that the criminal rules of procedure did not allow them. Then he ordered his friend and anti-Trump colleague who had already written an op-ed that Flynn should be charged with purgery to file an amicus brief and was going to allow him to engage in discovery. All of that is completely outside the norm and has likely never happened before in any federal court.

It reads like you're disagreeing, but I know you're not. Just to clarify for anyone else reading these two comments, Sullivan denied amicus intervention 24 times in this very case, before flipping out.

This part where he appoints an amicus who has prejudged the very same case in a very public manner is the part that has likely never happened before in any federal court. Even Fokker and the recent SC case with the name I can't spell didn't go quite this far off the rails.

Yeah, I noticed the same things. To be fair, the man has other things going on... for example, I'm pretty sure he battles some pretty severe depression that he's talked about a few times. I'll give the man sympathy there, nobody deserves that crap. His TDS is utterly painful, but the man has some principles. They're not always principles I agree with, but at least I'll admit he has them and give due credit.

Basically, he's arguing that, sure, this is the exact sort of "chickensh-t" perjury trap he hates (or at least, hated in 2011), but it's perfectly legal so screw Flynn. Also, they do have some points about materiality. Sure, they've long argued that it's an utterly bogus standard, but it is the standard.

That is the hard part here. I think the DoJ ought to make a new, fairer standard for this materiality, though and use it everywhere. Heck, maybe Ken would even agree with that.

Amicus briefs in criminal cases are wildly unusual. And the judge relied on that to deny amicus briefs multiple times through the life of the case. He can't think his move would have survived appeal. He's likely compromised.

Okay, this is the second time I've seen mention of the judge's son being a rapist. Had no luck in a cursory search finding any mention of his family at all. Like zero mention anywhere about anything, which is in itself odd.

So, I'm asking again for a link to some kind of source on this material, or even a resource that would help me find it myself. But don't be over here blueballing me with some bullshit. If they are hiding what has compromised this judge and it's provable I will put the info out there, but you have to give me something to go on.

Judges look pretty good, 2-1 our favor. The order cites Fokker, a case which says he has no authority to deny the DoJ's motion to dismiss as well as Rule 42(a). Both are strongly in Flynn's favor and this orders him to respond to this. He's also been given 10 days to respond, which places this petition before Sullivan's schedule for his amicus. So it prevents him from just sitting on the unopposed motion to dismiss while his amicus does their thing.

The government is also invited to reply to this if it wishes.

They are ignoring two parts of Sydney's appeal in this order, but those two parts will be irrelevant if they simply rule that Sullivan has no right to deny the government's motion to begin with, so it kind of looks like they're trying to simplify things and put this to rest.
