In Dante’s Inferno, the ninth and lowest circle of hell is reserved for the treacherous:
“Trapped in the ice, each according to his guilt, are punished sinners guilty of treachery against those with whom they had special relationships. The lake of ice is divided into four concentric rings (or "rounds") of traitors corresponding, in order of seriousness, to betrayal of family ties, betrayal of community ties, betrayal of guests, and betrayal of lords.
This is in contrast to the popular image of Hell as fiery; as Ciardi writes, "The treacheries of these souls were denials of love (which is God) and of all human warmth. Only the remorseless dead center of the ice will serve to express their natures. As they denied God's love, so are they furthest removed from the light and warmth of His Sun. As they denied all human ties, so are they bound only by the unyielding ice."
Read Sidney Powell's Licensed to Lie. Sullivan is basically the hero. He not only threw out the Ted Stevens case - a case which cost an honest Senator his reelection - he appointed a special investigator who exposed the DOJ as having fabricated the crime it accused Stevens of committing.
What happened between then and 2017? I think someone at DOJ dug up something on him so that he wouldn't do that to them again.
There are claims I can't verify on Twitter about shennigans with Sullivan's wife going into politics and whatnot else with his children getting away with crap. I won't repeat them because I cannot verify a word of it, but it sure does make a pede wonder.
Everyone's always legit when Democrats want to give someone false credibility. Mueller was supposed to be credible because he served under Bush, they drummed him up as the most respectable person for the job. Not one Democrat objected. They knew the fix was in.
He was legit from what I ever heard about him . . . till he suddenly wasn't. Whatever happened - or whenever he was allegedly made to flip it seems - possibly occurred very recently, within past 6 months, when he verbally attacked Flynn and Powell in open Court. Weird. He was the "hero" figure in her book, too, "Licensed to Lie", abt the Sen.Ted Stevens case. SMH. He just is not the guy anyone would have thought . . . from what little I knew abt him anyway.
He used to be a great, respected Judge. He was the "hero" of Sidney Powell's book, "Licensed to Lie", which was about the Alaska Sen. Ted Stevens case/set-up, which Judge Sullivan presided over! I was happy when Sullivan took Judge Contreras' (remember him???) place as Flynn's Judge, till he apparently . . . well something happened to him, seemingly around this past December.
What did Sullivan do specifically in the Stevens case that made him a hero? I don't remember any FBI agents being convicted and locked up in federal prison like in some of the Durham cases.
He seemed to be a very well-respected Judge, from all I read, prior to Flynn recently anyway, then something seemed to happen around December. I used the word "hero" as someone else used it to describe him in the book, and I could not think of a better one.
Not just that, at the start of the case he literally wanted the prosecutors to push for the death penalty. Easy to hide abuse and false prosecution when the man they've framed is put to death.
based on hatch act? a conversation that flynn knew they had the transcript for?
or some fara / tps violation that every fucking democrat gets to back fix without issue? what was the treasonous act?
Basically, of all the options they had, they chose the most rare and drastic one. They're also treating Sullivan as opposed to Flynn here by making him personally respond instead of letting him do that via an amicus.
So... they're already cutting the amicus he appointed out of this. Let's just say that this does NOT look good for Sullivan.
I wonder if Sullivan thought this hairbrained scheme up himself, or was he directed by other people to do it. I would love to see if he's had any recent communication with Weissmann.
I dont think the DOJ did. This is a DC judge, he got video'd misbehaving at a brothel, picked up for drug/drunk driving, or something like that. Some DC powerbroker is doing the leaning
He's been ordered to reply to this petition directly and NOT via his amicus. Some leftist Twitterati are complaining about the judges drawn. Advantage is on our side, for now.
I suppose, in theory, he could dump the whole thing and reply to the appellate court that their intervention was now moot due to that, but I just don't feel it. He's going to have to put all his cards on the table in the next 10 days.
He can't. In this same case he earlier entered an order prohibiting anyone from filling an amicus brief, explaining that the criminal rules of procedure did not allow them. Then he ordered his friend and anti-Trump colleague who had already written an op-ed that Flynn should be charged with purgery to file an amicus brief and was going to allow him to engage in discovery. All of that is completely outside the norm and has likely never happened before in any federal court.
It reads like you're disagreeing, but I know you're not. Just to clarify for anyone else reading these two comments, Sullivan denied amicus intervention 24 times in this very case, before flipping out.
This part where he appoints an amicus who has prejudged the very same case in a very public manner is the part that has likely never happened before in any federal court. Even Fokker and the recent SC case with the name I can't spell didn't go quite this far off the rails.
No problem, I just thought I'd clarify. Love reading your comments, you've made some good ones and made some good submissions on this. Would love to read more of your take on the "Watergate" amici and their briefs.
Here's the latest one that they filed with the DC Court of Appeals -
BEFORE: Henderson, Wilkins, and Rao, Circuit Judges
O R D E R
Upon consideration of the emergency petition for a writ of mandamus, it is
ORDERED, on the court's own motion, that within ten days of the date of this
order the district judge file a response addressing petitioner's request that this court order the district judge to grant the government's motion to dismiss filed on May 7, 2020 (ECF No. 198). See Fed. R. Crim. P. 48(a); United States v. Fokker Services B.V., 818 F.3d 733 (D.C. Cir. 2016). The government is invited to respond in its discretion within the same ten-day period.
The Clerk is directed to transmit a copy of this order to the district court.
Edit: Henderson is a Bush Appointee, Rao a Trump pick, and Wilkins Obama.
Bwahahaha - I like how the order helpfully points Sullivan to the Fokker case, which essentially holds that he has to grant the fucking order to dismiss the Flynn case.
I used to read Popehat, before he got TDS. Notice the last update on his website was a long time ago because instead of admitting he was wrong on Russia collusion, and saying anything positive about Trump and lose his substantial TDS audience, he just stopped posting.
Yeah, I noticed the same things. To be fair, the man has other things going on... for example, I'm pretty sure he battles some pretty severe depression that he's talked about a few times. I'll give the man sympathy there, nobody deserves that crap. His TDS is utterly painful, but the man has some principles. They're not always principles I agree with, but at least I'll admit he has them and give due credit.
Basically, he's arguing that, sure, this is the exact sort of "chickensh-t" perjury trap he hates (or at least, hated in 2011), but it's perfectly legal so screw Flynn. Also, they do have some points about materiality. Sure, they've long argued that it's an utterly bogus standard, but it is the standard.
That is the hard part here. I think the DoJ ought to make a new, fairer standard for this materiality, though and use it everywhere. Heck, maybe Ken would even agree with that.
Fuck that, that duplicitous shit stain goes on the "all the president's lawyers" podcast and bullshits about "Trump is fucked" "Democrats are right" ALL THE FUCKING TIME. Fuck him, he was wrong, and like the dems, he's doubling and tripling down. Fuck HIM!
Amicus briefs in criminal cases are wildly unusual. And the judge relied on that to deny amicus briefs multiple times through the life of the case. He can't think his move would have survived appeal. He's likely compromised.
I saw this a couple days ago and did a little digging in between. I found that the father of the girl his son is accused of raping is either a senator or a representative... I went back just now and did my same searches and the sites I found weren't in the results. Complete scrub job going on. I know you guys say to archive everything, I didn't heed your warning
Okay, this is the second time I've seen mention of the judge's son being a rapist. Had no luck in a cursory search finding any mention of his family at all. Like zero mention anywhere about anything, which is in itself odd.
So, I'm asking again for a link to some kind of source on this material, or even a resource that would help me find it myself. But don't be over here blueballing me with some bullshit. If they are hiding what has compromised this judge and it's provable I will put the info out there, but you have to give me something to go on.
"The district judge’s latest actions – failing to grant the Government’s Motion to Dismiss, appointing a biased and highly-political amicus who has expressed hostility and disdain towards the Justice Department’s decision to dismiss the prosecution, and the promise to set a briefing schedule for widespread amicus participation in further proceedings – bespeaks a judge who is not only biased against Petitioner, but also revels in the notoriety he has created by failing to take the simple step of granting a motion he has no authority to deny," the Tuesday petition read.
It accused Sullivan of being "an umpire who has decided to steal public attention from the players and focus it on himself. He wants to pitch, bat, run bases, and play shortstop."
"I am an asset of the deep state and am being burned in a last ditch attempt to delay this case until after the election where the DNC has planned fraud on a biblical scale to prevent any of their malfeasance coming to light"
Sullivan Replies: "An anonymous letter was sent to me. In it was a single photo of Justice Antonin Scalia sleeping peacefully in his room. The photo was dated February 13, 2016."
Judges look pretty good, 2-1 our favor. The order cites Fokker, a case which says he has no authority to deny the DoJ's motion to dismiss as well as Rule 42(a). Both are strongly in Flynn's favor and this orders him to respond to this. He's also been given 10 days to respond, which places this petition before Sullivan's schedule for his amicus. So it prevents him from just sitting on the unopposed motion to dismiss while his amicus does their thing.
The government is also invited to reply to this if it wishes.
They are ignoring two parts of Sydney's appeal in this order, but those two parts will be irrelevant if they simply rule that Sullivan has no right to deny the government's motion to begin with, so it kind of looks like they're trying to simplify things and put this to rest.
So why does the appeals court give Sullivan 10 days to explain his decision? Sullivan will test positive for COVID or some other excuse to further delay. I don't expect the supreme court to rule until after November election.
We need to get the word out that Sullivan is doing all of this because he has information that could lead to the arrest and conviction of Hillary Clinton. That should take care of the problem.
"It accused Sullivan of being "an umpire who has decided to steal public attention from the players and focus it on himself. He wants to pitch, bat, run bases, and play shortstop."
Sullivan: "Help I'm being blackmail-"
Hawaiian judge has entered the chat
Pretty sure this is the correct answer. The DOJ dug something up on him to make sure he would never pull a Ted Stevens on them again.
What has Sullivan done that makes you think that he isn't a disgusting Washington DC swamp rat with a superiority complex?
The fact that he yelled at Flynn saying that he was a traitor makes me think Sullivan is a bad person with bad judgement.
It does seem EVERYTHING the Democrats throw at or accuse Trump/Republicans/Trump supporters is shit the Democrats have done or are doing!!!
Welcome to the party.

Also Ted Stevens lost his seat - which had to have been the goal. The damage was done before Sullivan corrected the wrong.
Lost his seat, which was the one missing vote needed to pass Obamacare.
Getting rid of a Republican Senator was an added bonus, Obamacare was the goal
There are claims I can't verify on Twitter about shennigans with Sullivan's wife going into politics and whatnot else with his children getting away with crap. I won't repeat them because I cannot verify a word of it, but it sure does make a pede wonder.
I’ve also heard that he owes some favors for helping his scumbag son out of a brutal rape charge.
Problem is there's no way to confirm/deny that as far as I can see, so I'm taking it as an unproven rumor until we have something solid.
Oooooh...
Sure seems like it.
Yeah there was a lot of noise about him being some legit person a year or so back.
I bought into it at the time. Foolish me.
Everyone's always legit when Democrats want to give someone false credibility. Mueller was supposed to be credible because he served under Bush, they drummed him up as the most respectable person for the job. Not one Democrat objected. They knew the fix was in.
I legit wonder what Mueller did all day for two years while the lawyers worked on the SC.
Did he seriously just do crosswords for 2 1/2 years while leftists slobbered him constantly in the media?
Judging by his testimony in front of congress, I'm pretty sure he drooled on crosswords for 2 1/2 years.
I think him amd Wiessman probabaly spent a good amount of time jerking each other off to all the con jobs they pulled over the years
He was legit from what I ever heard about him . . . till he suddenly wasn't. Whatever happened - or whenever he was allegedly made to flip it seems - possibly occurred very recently, within past 6 months, when he verbally attacked Flynn and Powell in open Court. Weird. Sullivan was trying to argue for treason
Working for President Trump, I guess. Who can tell with these nutjobs
Can't wait for Weissman's trial
Here's a lawyer explaining why this ORDER to Sullivan is a big deal:
https://twitter.com/reeveslawstl/status/1263588369918906373
Basically, of all the options they had, they chose the most rare and drastic one. They're also treating Sullivan as opposed to Flynn here by making him personally respond instead of letting him do that via an amicus.
So... they're already cutting the amicus he appointed out of this. Let's just say that this does NOT look good for Sullivan.
Wow.
Popcorn.gif
I wonder if Sullivan thought this hairbrained scheme up himself, or was he directed by other people to do it. I would love to see if he's had any recent communication with Weissmann.
Obama telegraphed perjury to him.
Recall, so that he could not be accused of influencing the judge, the message got out by the media covering a “leaked phone call”.
This is an great explaination, thank you
Then out with it, whatever it is. Free the small children from this guy's basement.
I dont think the DOJ did. This is a DC judge, he got video'd misbehaving at a brothel, picked up for drug/drunk driving, or something like that. Some DC powerbroker is doing the leaning
Barr should have Sullivan's phone tapped to listen for the Kenyan.
Got this here dossier and Gateway Pundit article that would suggest you're right, good enough for FISA
I hereby order Flynn and his entire family to spend infinity days in Federal Prison. I have spoken! Good day!
The 4th Branch of Government: Hawaiian Judge
Hawaiian judge will overrule. LOL
Holy shit, he is going to have to go on the record with his reasoning, in other words he'd better have some damn sound reasoning (he doesn't)
Problem is, there is a higher court involved now. Plus, Powell wanted him removed and that must be heard.
I think the Court of Appeals wouldn't let it go that easily.
Yeah, he's been ORDERED to reply to them. Directly, not via his amicus.
It's subtle, but that's pretty important. They're calling him out on two major precedents that say he can't do what he just did, as well.
The order is tiny, but there are a lot of little barbs in it against him.
He did so 24 times!
It reads like you're disagreeing, but I know you're not. Just to clarify for anyone else reading these two comments, Sullivan denied amicus intervention 24 times in this very case, before flipping out.

Oh yeah, not at all disagreeing! Just saying he denied amicus 24 times! Thanks
No problem, I just thought I'd clarify. Love reading your comments, you've made some good ones and made some good submissions on this. Would love to read more of your take on the "Watergate" amici and their briefs.
Here's the latest one that they filed with the DC Court of Appeals -

And here's the original brief submitted to Sullivan -

I wrote a long rant about how bogus the one submitted to Sullivan is here -

I’ll be back after Friday night! Thank you! I’ve been following it!
Cool, I myself will be out on vacation next week so may not be around.
There's another new filing, this time an amicus on Flynn's side in the DC Court of Appeals from several state AGs -
https://sidneypowell.com/wp-content/uploads/2020/05/USCA20-5143-Doc.-1844061-BRIEF-for-the-STATES-as-AMICI-CURIAE-SUPPORTING-PETITIONER.pdf
They basically say "WTF, this judge is usurping our role" and cite a lot of stuff on separation of powers, prosecutorial discretion, etc.
"but but but Orange Man Bad!!!" is the excuse
Ignore the retractions in page 32z
page 32z in some other publicatioon.
They're in a locked file cabinet in a disused lavatory in the basement. You know, the one where the lights & stairs are out.
The lavatory has sign on the door saying 'Beware of the Leopard", doesn't it......
Yahoo news heard from a friend who heard from someone familiar with Flynn’s thinking
I got you:

Oh, snap! Sullivan is about to get BTFO!
Judges don't get removed from the bench just because they get overruled by a higher court.
Top kek
Ooh that could be fun. Barr going to re-submit his prior filing, or maybe throw some more logs on the fire?
Sidenote: The howling coming from the Dems about hauling Barr to testify in the House regarding the Flynn imbroglio sure dried up quick huh?
Barr should be having the DOJ agree with the writ of mandamus ASAP. What Sullivan is doing is an open assault on constitutional separation of powers.
It's about to be Memorial Day Weekend. Some things are still sacred in this great nation.
Proper observance of the sacred Memorial Day Weekend involves leaving work early on Friday.
Seriously, courts never issue an order with a one-day response deadline. 10 days is a rush order.
I see that the order is already linked, you can find more from @Techno Fog on twitter. Here are the judges:

This is something I really wish Flynn had read years ago that explains the perjury traps in detail.
Good advice from Popehat.
I used to read Popehat, before he got TDS. Notice the last update on his website was a long time ago because instead of admitting he was wrong on Russia collusion, and saying anything positive about Trump and lose his substantial TDS audience, he just stopped posting.

Appreciate the likes! Feel free to share.
Thanks. Was trying to find it myself.
Henderson was appointed by Reagan to District Court of South Carolina in 1986, GHWB appointed her to DC Court of Appeals in 1990

You should make a dedicated post about this! I am going to see if I can verify some of the information that should be public.
How did you come by this pede?
I saw this a couple days ago and did a little digging in between. I found that the father of the girl his son is accused of raping is either a senator or a representative... There should at least be some documents produced via arrest, plea, dismissal, etc if it's to be proven.
Also, the amicus lawyer (former judge) is in the same law firm as the lawyer who represents Sally Yates, a material witness in the Flynn case.
Conflict. Of. Interest.
I swear, everything connects back to the Lawfare group.
I wish we'd see a no-knock raid of them on TV at 4 AM.

What will Obama direct Sullivan to tell the DC Court of Appeals?
SPEZ: I wonder what retired federal judge John Gleeson now thinks about Sullivan inviting him into this legal shitshow?
Gleeson wrote a fucking op-ed against Flynn's dismissal before he was brought into this. He deserves it.
3 days before!
I'm sure the subject come up during his next reach-around.
"I am an asset of the deep state and am being burned in a last ditch attempt to delay this case until after the election where the DNC has planned fraud on a biblical scale to prevent any of their malfeasance coming to light"
"Who put truth serum in my water?!!"
Obviously this
Sullivan Replies: "An anonymous letter was sent to me. In it was a single photo of Justice Antonin Scalia sleeping peacefully in his room. The photo was dated February 13, 2016."
You forgot the recording. No words were recorded, but a cackling and coughing elderly female was overheard
WTF. Source please!!
it's a joke
At this point, it's hard to tell.
"I didnt want to be suicided by the clintons and obamas"
Judge needs to be removed from the bench, permanently!

So why does the appeals court give Sullivan 10 days to explain his decision? Sullivan will test positive for COVID or some other excuse to further delay. I don't expect the supreme court to rule until after November election.
It’s probably a provision in the court rules. Not unusual.
Why would the Supreme Court need to get involved? Do you think the Appeals court is going to let it slide?
or drag it out.
We need to get the word out that Sullivan is doing all of this because he has information that could lead to the arrest and conviction of Hillary Clinton. That should take care of the problem.
Sullivan had to know this was coming.
Not a lawyer. But is this not the equivalent of asking this judge:

yeah, pretty much this.
Thanks for the confirmation!
I love the shit outta that movie!
Gave him like 10 days to do it! Geez. I'd give him ten minutes and start counting now.

Judge Sullivan dindunuttin!
