Even then, the word is should. There was no need to endanger so many nursing homes by taking on patients from other hospitals without symptoms.
The other key point from his mandate is, it prohibited NHs from TESTING a patient for COVID. They couldn't even know whether or not the patient HAD it in order to tailor care for that patient to keep them safely away from other non-positive patients.
"No resident shall be denied re-admission or admission to the NH solely based on a confirmed or suspected diagnosis of COVID-19. NHs are prohibited from requiring a hospitalized resident who is determined medically stable to be tested for COVID-19 prior to admission or readmission."*
