IMMEDIATELY classify any and all online media "platforms" as "publishers" this includes REDDIT, FaceBook, Twitter, YouTube, ANY online platform that has decided to take a political stance, ban users due to political reasons, stifle the freedom of speech of a political movement on that platform or decided to setup "fact checking" panels filled with people who are veritably biased effective June 1, 2020.
After that we file Class Action Lawsuits against Reddit, YouTube, Twitter, FaceBook, etc for stifling political speech and taking a clear political stance on many issues against the conventions of an "open platform", just enforce what's already on the books. That's the point when ALLLLLLLL the sreenshots, logs, admin messages and deleted posts/accounts all come to light for the lawsuits and these companies begin to burn.
I'll reserve judgement until I see what's in it. Every time I see people applauding Trump for executive actions, I always consider the precedent being set for future Presidents.
Shut down Twitter? It might sound OK, but a liberal President in the future could use the same authority to shut down TheDonald.win.
The problem is, there is no existing law he can enforce. 1st Amendment doesn't apply here. If Twitter is declared a publisher and made responsible for every comment on their platform, I think that would stifle free speech in a bad way.
I think this altercation will bring the topic to the forefront, which is very timely going into the election.
The Fifth Amendment's Due Process Clause requires the United States government to practice equal protection.
The Fourteenth Amendment's Equal Protection Clause requires states to practice equal protection.
3.Equal protection forces a state to govern impartially—not draw distinctions between individuals solely on differences that are irrelevant to a legitimate governmental objective. Thus, the equal protection clause is crucial to the protection of civil rights
All of that applies to government, not the private sector. If I sent a conservative Letter to Editor to the NYT, I would have no recourse if they refused to print it. I'm OK with that.
It would apply to twitter as well since the judicial branch ruled that Trump's twitter is an official government record and as such he can't block users.
Something about in kind campaign contributions or publisher status would be nice. Client enforceable legal jargon roughly translating too “if you editorialize & censure your a publisher, if you use your new publisher status to remove all content you don’t like, pontentially political content in favor of one side, then you are making an in kind campaign contribution that must be labeled as such and can’t exceed the limit allowed by one entity”
