If the situation is life-threatening, including the attacker having ALL 3 points: Ability to cause bodily harm or death (has the means) Opportunity to cause bodily harm or death (has the opportunity) One's life is in Jeopardy (has intent) I don't care where the gun came from, you defend yourself.
