This is just hypothetical thinking here... Would the current situation warrant a national emergency? If the shutdown or slow-to-reopen states are hot spots for the protesting/looting/rioting, then would it make sense to get everyone back to life, back to work, back to normal rather than continue to fan the flames under draconian lockdowns? When you have massive protests (that ironically far exceed the protest limits that had been placed on the civil lockdown protestors), minimal mask use, no social distancing... I think it's pretty clear there's absolutely no point in having anything closed now. For the safety of everyone, everything should be open.
