And pedestrians don't have the right of way on the freeway either. On top of that, they don't have the right of way at all if they are crossing the road outside of a crosswalk. And no crosswalks exist on the freeway. Of course this is all moot, but it just shows how the driver is covered from every angle.
When the first BLM riots happened in the Bay, they had protestors crowding out into the freeways, at night, in areas where there aren’t any lights. Naturally, some of the protestors got ran over because the driver’s can’t see that they’re there and they shouldn’t fucking be there. People filmed some of that to the extent you can really see anything since it was almost pitch black. They were trying to track down the driver in one, but I mostly wanted to pitch in to fix any dents in the driver’s car.
In my state pedestrians always have the way when crossing a roadway (not highways though) whether in a marked or unmarked crosswalk. WTF is an unmarked crosswalk? The fucking street. It’s ridiculous. My city also has one of the highest pedestrian fatality rates.
Where streets intersect. It isn't complicated at all.
I'm pretty sure that most if not all states require a person not crossing in a crosswalk to yield the right of way to vehicles. But this is apples and oranges anyways, as he was clearly not merely crossing the road.
