The state should be only giving benefits to heterosexual couples because the state wants to entice people up get married, have children, and raise them in a stable family. That's how you have a healthy society.
Personally, with how things are, I'd get rid if the marriage tax break and jack up the child credit and only make people eligible if they're married. Then allow them to continue to claim the credit after the children are no longer dependents.
