the Twitter user who posted this said she got is from this Sarah Carter blog about the hearing:

Hillary Clinton lost the appeal. The D.C. Circuit Court of Appeals submitted the case, which is adjourned until Wednesday, September 9 at 9:30 a.m., when the former Secretary of State will have to testify.

It seems oddly flippant to throw that into the last paragraph of the blog. I'm suspecting they had that prepared as an update and it slipped into the published blog? I don't know. I don't see anywhere that the Court actually made a ruling.
