This is starting to sound alot like, oh you can dismiss, just not with prejudice, so they're looking for a way to wiggle out of that caveat, so they can chase after him again later.

Exactly. It's the very thing rule 48(a) is supposed to prevent. A true travesty of justice.

They don't want it dismissed with prejudice because it will bolster his lawsuit against the govt for their malicious prosecution.
