If you shoot a guy dead in the street to "affect and arrest", is it really an arrest? You are not allowed to use deadly force to "affect an arrest" because when you kill someone, you can't arrest them, now can you?
You can only use deadly force when the officer believes that he is under threat of death (he wasn't) or serious bodily harm (he wasn't), or the suspect presents an immediate danger to the public (he didn't).

Only if he put himself in range of the weapon. Clearly the dynamics of the situation changed when he went from an unarmed drunk to someone that now possessed a taser and is actively trying to flee.

The suspect was running away. When the cop fired, the taser charge was spent to no effect. The suspect was unarmed and 10-15 feet away from the officer, and fleeing. These are the facts. Period.

There have been plenty of activist “court experts” who have testified that tazers are lethal force and plenty of municipalities have payed out the ass in settlements and court decision for their use.
Lethality arguments aside, a tazer shot would incapacitate the officer long enough for the violent criminal to steal the officer’s firearm and use it.

He pointed the taser high at the cop's face and it did go off. Look at the video here at 17-19 second mark. At 18 second mark you see him turn around and point it high and you can see the brightness of it going off.

It doesn't matter if the taser went off or not. A taser is by definition a non-lethal weapon. It does not put the officer's life or anyone's else life in danger, which by law is the only time an officer is allowed to use deadly force.
These are the facts. Pay attention. No hypotheticals. No "what if then this happened" bullshit. That is complete fantasy. The officer's mindset, or what he believed was about to happen is irrelevant to the facts of what DID happen.
The suspect was running away. When the cop fired, the taser charge was spent to no effect. The suspect was unarmed and 10-15 feet away from the officer, and fleeing. After the taser fired, the officer was fine and his partner was fine. Neither of them were under any threat of serious bodily harm or death. Then the officer drew his weapon and fired. These are the facts. Period.
You don't not get to shoot suspects when they are fleeing. That is not correct police procedure. The law does not permit it. You can cry and call me retarded all day long. It doesn't matter. That's not the way things work in this country.
The job of the police is to apprehend criminals, not execute them. This cop pulled because he just got his ass handed to him and his taser taken. Understandable, but not justified. He made a bad decision, period.
Having a taser fired at you does not constitute serious bodily harm or an imminent threat of death. Nor does it constitute an immediate danger to the public. These are the criteria in which an officer is permitted to use deadly force. You may not like that. I don't fucking care. This is a nation of laws and we don't live in a police state. We have rights.
You can cry all day long about how he was a felon, etc. It doesn't matter. None of that is admissible in court, and for the exact reason that it doesn't matter.
Cops need to chill the fuck out and stop shooting American citizens. They're real fucking trigger happy, and we've reached a point where everyone knows it. If you're fucking stupid enough to start defending these cops who make shitty decisions, you will see everything turn against you. Americans do not want anymore fleeing, unarmed suspects shot by police when there were clear alternatives. And there were clear alternatives, and you know it. Everyone knows it.
